CHAP. XIII.

An Act in additon to "An Act for the direction of Listers in their office and duty."

§ 1. BE it enacted by the Governor and Council and

House of Representatives in General Court

assembled, That the stock in the banks of this state be- Bank stock longing to any person or persons not inhabitants of this belonging to state, and standing in his or their names on the books of to be set in the such banks on the 20th of August in each year, shall be set in the list at three dollars on every hundred dollars, and shall be liable to all taxes, as is provided relating to bank stock owned by inhabitants of this state.

§ 2. Be it further enacted, That the listers in each town in which a bank or banks are established, shall sometime between the 20th of August and the 10th of September in each year, apply to such bank or banks, and obtain the names and "amount of stock of all stockholders in said banks, respectively, who are not inhabitants of this state and the respective cashiers of such banks shall, on application as aforesaid, deliver to the said listers a certificate of the names of such owners of stock with the amount holden by each owner, and such listers shall insert such stock in the respective lists in the same manner as is by law provided in regard to the property of nonresidents. And the respective collectors of the state tax in such towns, shall be the collectors of all the taxes arising on such stock.

3. Be it further enacted, That the banks aforesaid shall pay all the taxes due on the aforesaid stock, and shall have a lien on such stock to reimburse the amount there

of: and the collectors aforesaid shall pay over to the treasurer of this state, for the use thereof, all such sums of money as may be collected by virtue of this act.

§ 4. Provided, That the stock hereby directed to be set in the list shall not be deemed any part of the list of the town, to increase their state tax, or to enable them to draw a greater proportion of the school monies. General Assembly, May Session, 1812.

An Act for the limitation of actions on negoti able Notes.

E it enacted by the Governor and Council and House of Representatives in General Court assembled, That no suit, process, or action, shall be brought on any promissory note, made and executed after the rising of this as sembly, for the sum of thirty-five dollars, or more, for the payment of money only, and made payable to any person or persons, his, her, or their order, or to bearer, but within six years next after the right of action shall

accrue.

Provided nevertheless, That the time the maker of makers of such note shall be out of this state, shall not be computed as a part of the time limited by this act. General Assembly, May Session, 1812.

An Act to raise certain Volunteer Corps.

§ 1. BE it enacted by the Governor and Council and Military ex.

House of Representatives in General Court as sembled, That whenever a sufficient number of able bodied men, exempt by law from military duty, to form a full company of infantry, shall associate for that purpose, and ed. equip themselves to the acceptance of the commander in chief, and engage for a term not less than three years, unless sooner discharged by law, the commander in chief, upon application to him made, shall issue his order to some suitable person to lead said company to a choice of the same number and grades of commissioned officers, as Company offi the companies of infantry in the militia now have; which cers how ap pointed. officers, when approved by the commander in chief, shall be commissioned by him; snd such volunteer companies shall be entitled to the same number of non-commissioned officers and musicians as the companies of infantry in the militia, and to be appointed in the same manner; and the commanders thereof may enlist from exempts from time to time to fill such volunteer companies; and whenever a sufficient number of companies shall be raised the commander in chief may form them into baitallions and regiments; and as occasion may require form such regiments into brigades and divisions, and the field Field officers how appoint and general officers shall be appointed and commissioned ed. by the commander in chief.
