CHAP. VII.

An Act relating to the taking of Depositions out of this State.

Eit enacted by the Governor and Council and House of Representatives in General Court assembled, That when and so often as it shall be necessary, to take the deposition of any person or persons, resident out of this state, to be used in the superior court, or either of the county courts in this state, the party wishing to take the same, may, if the cause be pending in the superior court, apply to either of the judges of the superior court, when the court is not in session, (giving the adverse party due notice to appear before such judge) to issue a commission to tak esuch deposition; which commission, the said judge, is hereby authorized to issue : and in case the said deposition, shall be returnable to the county court, the judge of such county court, when the court is not in session, shall have the like power, notice as aforesaid being given, which commissions thus issued, shall be as valid, and authentic, as if issued by such court.

CHAP. VIII.

An Act in alteration of an Act, entitled "An
Act to encourage the raising of Sheep."

E it enacted by the Governor and Council and House of Representatives in General Court assembled, That from and after the present year, the listers in deducting from the sum total of the several lists, on account of the number of sheep inserted therein, in pursuance of the act of which this is an alteration, shall deduct for no greater number than twenty from any one list, any law to the contrary notwithstanding.

An Act in addition to and alteration of an Act, entitled "An Act for appointing, regulating and encouraging Schools."

E it enacted by the Governor and Council and House of Representatives in General Court assembled, That whenever the inhabitants of any school-district, shall be legally assembled for the purpose of granting a tax, for any of the purposes, for which they are by law authorized to tax themselves, the question shall be determined by the major vote of those present at such meeting, any law to the contrary notwithstanding.

CHAP. I.

An Act in addition to "An Act incorporating a part of the town of Middletown."

E it enacted by the Governor and Council and Common § 1. § 2. And be it further enacted, That for the purpose of rendering such side-walks convenient, said Court of Common Council may, from time to time, give order to the proprietor or proprietors of the lands and buildings fronting on such side-walks, at their own expence, to level or raise the same on their several fronts, according to the width, course, height and level designated as aforesaid; and also to pave or flag, and protect by posts or otherwise, and to improve in such manner as said Court of Common Council shall direct any side-walk in said city, as well those which have been heretofore designated by said Court of Common Council in pursuance of the by-laws of said city, as those which shall hereafter be designated in pursuance of this act.
