Mr. Speaker refumed the chair, and Mr. Boudinot reported, that the committed had, according to order, again had the faid report under confideration, end come to a refolution thereupon, which he delivered in at the Clerk's table, where the fame was again twice read, and agreed to by the House, as followeth : Refolved, That the tonnage on all foreign built bottoms, belonging to nations not in commercial treaty with the United States, be raised to the fum of one dollar per ton, from and after the first day of January next; and that from and after the the tonnage on all fuch veffels be raised to and that from and after the day of no fuch veffel be permitted to export from the United States, any unmanufactured article being the growth or produce thereof. Provided that this refolution fhall not be extended to the veffels of any nation, which permits the importation of fish, other falted provifion, grain, and lumber in veffels of the United States.

Mr. Speaker-The Senate have agreed to the report of the joint committee, appointed to confider and report their opinion on the question, "When, according to the Conftitution, the terms for which the Prefident, Vice-Prefident, Senators and Reprefentatives, have been respectively chofen, fhall be deemed to have commenced?" and alfo to confider and report their opinion on such other matters as they should conceive to have relation to this question: They have alfo paffed the bill, intituled, "An act for the encouragement of learning, by fecuring the copy-rights of maps, charts, books and other writings, to the authors and proprietors of fuch copies, during the times therein mentioned," with feveral amendments, to which they defire the concurrence of this House: And then he withdrew.

Mr. Bland, from the committee to whom was referred a motion of the feventh intant, refpecting the arrears of pay due to a part of the troops of the Virginia, North-Carolina, and South-Carolina lines, made a report, which was read, and ordered to lie on the table.

A petition of fundry perfons, citizens of the United States, captured by the Algerines, and now in flavery in Algiers, was prefented to the House and read, praying the interpofition of Congress in their behalf, and that effectual meafures may be adopted for liberating them from flavery, and reftoring them to their country.

Ordered, That the faid petition be referred to the Secretary of State, with inftruction to examine the fame, and report his opinion thereupon to the House.

Mr. Wadsworth, from the committee appointed, prefented, according to order, an amendatory bill to regulate the trade and intercourfe with the Indian tribes, which was received and read the first time.

Mr. White, from the managers appointed on the part of this House, to attend the conference with the Senate on the fubject matter of the amendments depending between the two Houfes to the bill fent from the Senate, intituled, "An act for giving effect to the act therein mentioned, in refpect to the state of North-Carolina, and to amend the faid act," made a report, which was read, and ordered to lie on the table.

Mr. Silvester, from the committee to whom was referred the petition of Thomas Jenkins and others, made a report which was read and ordered to lie on

the table.

The orders of the day were read, and poftponed until Monday next.
And then the House adjourned until Monday morning eleven o'clock.

MONDAY, May 17.

An amendatory bill to regulate trade and intercourse with the Indian tribes, was read the fecond time, and ordered to be committed to a committee of the whole House, on Wednesday next.

Mr. Madifon, from the committee appointed, prefented, according to order, a bill concerning the navigation and trade of the United States, which was re ceived and read the first time.

A member, in his place, prefented to the Houfe a representation from the commiffioners of pilotage in the state of South-Carolina, which was read, and ordered to be referred to the Secretary of the Treasury.

The House proceeded to confider the report of the committee to whom was. referred the petition of Thomas Jenkins and others: Whereupon,

Ordered, That the faid report be committed to Mr. Silvefter, Mr. Hartley, and Mr. Tucker, with inftruction to prepare and bring in a bill or bills purfuant thereto.

The House proceeded to confider the report of the managers appointed ou the part of this Houfe, to attend the conference with the Senate, on the subject matter of the amendments depending between the two Houses, to the bill fent from the Senate, intituled, "An act for giving effect to the act therein mentioned, in refpect to the state of North-Carolina, and to amend the faid a&:" Whereupon,

Refolved, That this Houfe do recede from their firft amendment, and in lieu thereof, propofe to ftrike out, in the last line of the third section, the words, "And Hillsborough alternately, beginning at the first."

Refolved, That this House do infift on their fecond amendment.

Refolved, That this Houfe do agree to the said refolutions, amended to read as follow:

Refolved, That the President of the United States be requested to cause to be forthwith transmitted to the executives of the states of Virginia, North-Carolina and South-Carolina, a complete lift of the officers, non-commiffioned officers and privates of the lines of those States refpectively, who are entitled to receive arrears of pay due for fervices in the army, in the years one thousand feven hundred and eighty-two, and one thousand feven hundred and eighty. three, annexing the particular fum that is due to each individual, with a request

to the executives of the faid States, to make known to the claimants in the moft effectual manner, that the said arrears are ready to be discharged on proper application.

Refolved, That the Prefident of the United States be requested to cause the Secretary of the Treafury to take the neceffary steps for paying, (within the faid States refpectively,) the money appropriated by Congrefs on the twenty-ninth day of September, one thousand seven hundred and eighty-nine, for the discharg ing the arrears of pay due to the troops of the lines of the faid States refpectively. Refolved, That the Secretary of the Treafury, in cafes where the payment has not been made to the original claimant, in perfon, or to his reprefentative, be directed to take order for making the payment to the original claimant, or to fuch perfon or perfons only as fhall produce a power of attorney, duly attested by two juftices of the peace, of the county in which fuch person or perfons refide, authorizing him or them to receive a certain specified fum. Ordered, That the Clerk of this House do carry the said resolutions to the Senate and defire their concurrence.

The orders of the day were read, and poftponed until to-morrow.

TUESDAY, May 18.

A bill concerning the navigation and trade of the United States, was read the fecond time, and ordered to be committed to a committee of the whole House to-morrow.

A petition of Mary Catherine Goddard, of the town of Baltimore, was prefented to the House and read, praying payment of a claim against the United States. Also,

A memorial of Dominique L. Eglize, praying an augmentation of the penfion heretofore granted him, in confideration of imprisonment and fufferings during the late war.

Alfo a petition of Richard Phillips, praying payment of a claim against the United States.

Ordered, That the faid petitions and memorial be referred to the Secretary of the Treasury, with inftruction to examine the fame, and report his opinion thereupon to the House.

A memorial of William Taylor, was prefented to the House and read, praying to be allowed the commutation of full pay in lieu of half-pay for life, as an officer in the late army of the United States. Also,

A petition of Timothy Hofmer, praying to be allowed the depreciation of pay as a furgeon in the hofpital of the eastern department, during the late war. Ordered, That the faid petition and memorial be referred to the Secretary at War, with instruction to examine the fame, and report his opinion thereupon to the House.

The Speaker laid before the Houfe a letter and report from the Secretary at War, on the petition of Samuel Carleton, which was read, and ordered to lie on the table.

The Houfe, according to the order of day, refolved itself into a committee of the whole Houfe, on the report of the committee appointed to confer with a committee of the Senate, to confider and report their opinion on the question, "When, according to the Conftitution, the terms for which the President, Vice-Prefident, Senators and Representatives, have been refpectively chosen, shall be deemed to have commenced?" and alfo to confider of, and report their opinion on, fuch other matters as they fhall conceive to have relation to this question."

Mr. Speaker left the chair.

Mr. Speaker refumed the chair, and Mr. Seney reported, that the committee bad, according to order, had the faid report under confideration, and made no amendment thereto.

Refolved, That this House do agree to the faid report, amended to read as followeth :

That the terms for which the Prefident, Vice-Prefident, Senate and Houfe of Representatives of the United States, were refpectively chofen, did, according to the Conftitution, commence on the fourth of March, one thoufand feven hundred and eighty-nine: And fo the Senators of the first class, and the Reprefentatives will not, according to the Conftitution, be entitled, by virtue of the fame election by which they hold feats in the present Congrefs, to feats in the next Congrefs, which will be affembled after the third of March one thoufand seven hundred and ninety one: And further, That whenever a vacancy shall happen in the Senate or House of Representatives, and on election to fill fuch vacancy, the perfon elected, will not, according to the Conftitution, be entitled, by virtue of fuch election, to hold a feat beyond the time for which the Senator or Representative in whofe ftead fuch perfon thall have been elected, would, if the vacancy had not happened, have been entitled to hold a feat.

That it will be advisable for the Congrefs to pass a law or laws, for determining, agreeable to the provifion in the first section of the second article of the Conftitution, the time when the electors fhall, in the year which will terminate on the third of March, one thousand seven hundred and ninety-three, and fo in every fourth year thereafter, be chofen, and the day on which they fhall give their votes, for declaring what officer fhall, in cafe of vacancy, both in the office of Prefident and Vice-Prefident, act as Prefident; for affigning a public office, where the lifts mentioned in the fecond paragraph of the firft fection of the second article of the Conftitution, fhall, in cafe of vacancy in the office of Prefident of the Senate, or his abfence from the feat of government, be in the mean time depofited; and for directing the mode in which fuch lifts fhall be tranfmitted.

Ordered, That a bill or bills be brought in pursuant to the last paragraph of the faid report, and that Mr. Benfon, Mr. Clymer, Mr. Huntington, Mr. Moore, and Mr. Carroll, do prepare and bring in the same.

The feveral orders of the day were read, and poftponed until to-morrow. And then the Houfe adjourned until to-morrow morning eleven o'clock.

WEDNESDAY, May 19.

The Houfe, according to the order of the day, refolved itself into a com mittee of the whole Houfe, on the bill making provision for the debt of the United States.

Mr. Speaker left the chair.

Mr. Seney took the chair of the committee.

Mr. Speaker refumed the chair, and Mr. Seney reported, that the committee had, according to order, had the faid bill under confideration, and made fome progress therein.

Refolved, That this House will, to-morrow, again refolve itself into a committee of the whole Houfe on the faid bill.

Carolina, and to amend the said act," and agree to the said amendment, as amended by this Houfe: They do adhere to their difagreement to the second amendment propofed by this Houfe to the faid bill: The Senate have also paffed a bill, intituled, "An act to prevent bringing goods, wares and merchandizes from the ftate of Rhode-Ifland and Providence Plantations into the United States, and to authorize a demand of money from the faid State," to which they defire the concurrence of this House: And then he withdrew. The faid bill was read the first time.

Ordered, That the committee to whom was referred the report of the Secretary at War, on the petition of John Rogers, in behalf of himself and others, be discharged from further proceeding thereon; and that the faid petition be again referred to the Secretary at War, with inftruction further to examine the fame, and report his opinion thereupon to the House.

THURSDAY, May 20.

The bill fent from the Senate, intituled, "An act to prevent bringing goods, wares and merchandizes from the state of Rhode-Island and Providence Plantations into the United States, and to authorize a demand of money from the faid State," was read the second time, and ordered to be committed to a cominittee of the whole House on Monday fe'nnight.

The House proceeded to re-confider their fecond amendment proposed to the bill fent from the Senate, intituled, " An act for giving effect to the act therein mentioned, in respect to the state of North-Carolina, and to amend the faid act," their difagreement to which the Senate do adhere to: Whereupon, Refolved, That this House do adhere to the faid amendment.

Ordered, That the Clerk of this House do acquaint the Senate therewith. Ordered, That a committee be appointed to prepare and bring in a bill or bills to extend the "act to establish the judicial courts of the United States," to the state of North-Carolina; and a committee was appointed of Mr. Williamfon, Mr. Gerry, and Mr. Steele.

Mr. Burke, from the committee to whom was referred the memorial of Nathaniel Twining, made a report, which was read, and ordered to lie on the table.

Mr. Stone, from the committee to whom was referred the petition of Francis Mentges, made a report, which was read, and ordered to lie on the table. The Speaker laid before the Houfe a letter and report from the Secretary at War, on the petition of Henry Emanuel Lutterloh, which were read, and ordered to lie on the table.

Ordered, That the report of the committee to whom was referred the petition of Richard Wells and Jofiah Hart, be referred to the committee of the whole House, to whom is committed the bill making provision for the debt of the United States.

The Houfe, according to the order of the day, again refolved itself into a committee of the whole House, on the bill making provifion for the debt of the United States.
