State Printer proceed to distribute the same by mail to the clerks of the District Courts of the several counties in the State, pro rata, according to population. But each county shall receive at least ten copies.

CHAPTER 5.

SHERIFFS MAY ADMINISTER OATHS.

AN ACT to authorize Sheriffs to administer oaths in certain cases.

SECTION 1. Be it enacted by the General Assembly administer of the State of Iowa, That Sheriffs and their Deputies, shall have power to administer oaths in all cases of the appraisement of property, on an attachment or execution or any proceeding connected therewith, and also, to administer oaths in all other cases, where Sheriffs are authorized by law to select commissioners or appraisers or empannel jurors for the purpose of appraising, or of viewing premises or property.

AMENDING SECTION 800 OF THE REVISION.

MILEAGE-ELEVENTH GENERAL ASSEMBLY.

AN ACT making appropriation for the payment of mileage of the members of the Eleventh General Assembly.

SECTION 1. Be it enacted by the General Assembly of the State of Iowa, That the following sums of Money apmoney, or so much thereof as may be necessary, are propriated. hereby appropriated for the purpose herein after designated.

SEC. 2. For the payment of the mileage of the members of the Senate, including Ex-Lieutenant-Governor Eastman and Lieutenant-Governor Gue, and contesting gentlemen holding certificates of election, the sum of two thousand six hundred and seventy-nine dollars [$2,679.]

SEC. 3. For the payment of the mileage of the members of the House of Representatives the sum of House, $5,592 five thousand five hundred and ninety-two dollars [$5,592.]

SEC. 4. The money thus appropriated shall be paid, by the Treasurer of State, upon warrants drawn by the Auditor of State, who shall issue his warrants to the members of the Senate and House, including Ex-Lieutenant-Governor Eastman and Lieutenant-Governor Gue, and the contesting gentlemen holding certificates of election in the Senate, for the amount due to each, as shown by the report of the committee on mileage, of that Branch of the General Assembly, of which such person is a member; and it is hereby made the duty of the President and Secretary of the Senate, and the Speaker, Sec. Speaker and Clerk of the House, to furnish immediClerk--duties ately, to the Auditor of State, copies of the report of the committee on mileage of their respective Houses, which copies shall be certified to be correct, by the officers herein required to furnish them, provided that no person shall receive mileage by virtue of this act, except as provided by sections two and three of said act. COURTS- -FIFTH JUDICIAL DISTRICT.

AN ACT fixing the times of holding Courts in the Fifth Judicial
District of the State.

SECTION 1. Be it enacted by the General Assembly

of the State of Iowa, That the times for holding the Courts 5th several District Courts in the Fifth Judicial District of District. this State, shall hereafter be as follows:

In the county of Polk, on the first Monday in Feb- Polk Cɔ. ruary, and the second Monday in July of each year.

In the county of Warren, on the second Monday in Warren Co. March, and the third Monday in August, of each year.

In the county of Madison, on the 4th Monday in Madison Co. March, and the first Monday in October, of each year.

In the county of Adair, on the second Monday after Adair Co. the fourth Monday in March, and the third Monday in October, of each year.

In the county of Guthrie, on the third Monday after Guthrie Co. the fourth Monday in March, and on the second Monday in September, in each year.

In the county of Dallas, on the fourth Monday after Dallas Co. the fourth Monday in March, and on the first Monday in September, in each year.

In the county of Carroll, on the third Monday in Carroll Co. September, in each year.

In the county of Greene, on the Thursday after the Greene Co. third Monday in September of each year.

In the county of Audubon, on the fourth Monday in Audubon Co. October of each year.
