Notice given.

Board of registration, when not

at any session or sessions thereof, have the power and authority by this act given to a city or township clerk in receiving applications for registration and in registering the names of electors, and shall be governed by all the provisions of this act as to the receiving of applications and registering of names by township or city clerks.

SEC. 7. At least one week's public notice shall be given by the township or city clerk of the date, place, hours of meeting and the purpose of the session of the board or boards of registration in any such township or city. Such notice shall be given by posting written or printed notices in at least five conspicuous places in each voting precinct, or by publishing such notice in some newspaper or newspapers published in said township or city, if any newspaper be published therein. SEC. 8. As soon, at least, as the hour fixed for the commencement of any meeting of a board of registration, the clerk of the township or city, as the case may be, shall deliver to said board the registration book or books for each election precinct in the registration district for which such board of registration was appointed; and at the close of its session each board of registration shall immediately deposit the registration book or books with the township or city clerk and said clerk shall carefully preserve the same in his office. ·

SEC. 9. Whenever a re-registration is to be had, pursuant to the provisions of this act of the qualified electors of a townprovided for. ship or city which has not provided for a board or boards of registration according to the provisions of this chapter, the township board or legislative body, as the case may be, may, in its discretion, by resolution, passed by a majority vote of the members-elect, provide that, for the purposes of such re-registration only, there shall be a board or boards of registration in such township or city, and in such case all the provisions of this chapter shall apply with like force and effect to such re-registration for that year and no longer.

SEC. 10. Each member of a city board of registration while acting under this act shall be entitled to receive such com pensation as shall be fixed by the legislative body of the city at the time of appointment. Each member of a township board of registration shall receive the same compensation as provided by law for township inspectors of election.

SEC. 11. In every city whose charter contains provisions for the selection of boards of registration, by a city election commission, and for the performance of the duties of such boards, said charter provisions relating to selection of boards of registration shall not be superseded by this chapter, but the persons selected pursuant to such charter provisions shall be the boards of registration for such city under this chapter, and shall perform the duties required of them in the manner provided by such charter.

CHAPTER VI.

Registration in Villages.

SEC. 5. Each member of the said board of registration shall, before entering upon the discharge of his duties, take and subscribe the constitutional oath of office.

SEC. 6. Said board of registration shall have the same power and authority, and shall perform the same duties, relative to registration, by this act conferred upon and prescribed for boards of registration in townships and cities.

SEC. 7. As soon as the person elected village clerk at such first village election shall have qualified and entered upon the duties of his office, he shall procure for such village, at the expense of the village, such a registration book as is prescribed by this act for townships and cities; and shall enter in such registration book the names, addresses, etc., of the qualified electors as registered by the board of registration preceding such first election. When completed such book shall thereafter be the registration book for such village.

CHAPTER VIII.

CHAPTER IX.

Investigation of Registrations.

SECTION 1. Whenever it shall come to the knowledge of any Illegal township, city or village clerk that there is probable illegal or investigation fraudulent registration in his township, city or village, or of. any precinct thereof, he shall have the power, and it shall be his duty, to make full investigation of the facts concerning such registration and to ascertain whether any names have been illegally or fraudulently registered. To this end such clerk is hereby authorized and empowered to call upon the police department of the city or the sheriff of his county, or both, to assist in making such investigation, and said police department and said sheriff are hereby required to render such assistance whenever the said clerk shall make request therefor, and to furnish to said clerk, at his request all available men to assist in making such investigation. Any Assistant such clerk is hereby further authorized and empowered, whenever he deems it necessary or advisable, to appoint assistant examiners for the purposes of such investigation. Bills for the services of such examiners shall be approved by such clerk, and shall be audited and paid by the township board or legislative body of the township, city or village, as the case may be, in the same manner as the expenses of conducting elections are paid.

SEC. 2. Whenever the city, township or village clerk shall To notify determine that any name has been illegally or fraudulently attorney. entered upon the registration book of any election precinct in his city, township or village, or that there is good cause to believe that any name has been illegally or fraudulently registered, he shall write the word "challenge" opposite such name in the registration book, and shall lay before the prosecuting attorney of the county all the facts touching such registration. If at any election any person shall offer to vote, claiming to be the person opposite whose name the word "challenge" appears on the registration book, the inspectors of election shall at such time examine him under

oath as to his qualifications as an elector in such precinct, the same in all respects and with like effect as though he had been challenged at the election by a challenger thereof.

CHAPTER X.

Miscellaneous Provisions.

SECTION 1. Every township clerk, within fifteen days after each general November and biennial spring election, shall make, certify to and transmit to the county clerk of his county, for filing in his office, a true copy of the contents of the registration book or books of his township, for which, when received, the county clerk shall give such clerk a receipt. Such clerk shall be entitled to receive for such copy, from the township, a fee at the rate of fifty cents for each one hundred names. Such copy, or a copy thereof certified to by the county clerk, shall be prima facie evidence of the contents of the original, and, in case of the loss or destruction of the original, shall be used in its stead.

SEC. 2. Any township or city clerk, on the demand of any qualified elector and on payment or tender of a fee at the rate of fifty cents for each one hundred names, shall make, certify to and deliver to such elector a true copy of the contents of any registration book in his custody, but this shall not be so construed as to prevent any person by himself or a clerk, making copies of such registration books, under the supervision of the said township or city clerk.

CHAPTER XI.

Penalties.

SECTION 1. Any wilful violation of duty by any person charged with the execution of this act or any provision thereof not herein particularly provided for, shall be deemed a misdemeanor, and the person guilty thereof shall be punished accordingly. It is hereby made the duty of every prosecuting attorney, whenever he shall receive credible information that any such offense has been committed, to cause the same to be prosecuted.

SEC. 2. Any person who violates any provision of this act, not herein particularly provided for, shall, upon conviction, be deemed guilty of a misdemeanor.

SEC. 3. Any person who wilfully fails to perform any duty enjoined upon him by any provision of this act, shall, upon conviction, be deemed guilty of a misdemeanor.
