portion of the real estate of said hospital, as also to sell so much of said property as may be necessary to purchase, build or improve a hospital of dimensions and size adequate to the object of the institution. The said board shall have the right to sue and be sued, implead or be impleaded, in any suits and actions, before any court of this State. The president of the board is hereby designated as the person on whom all legal notices are to be made which may be made on him personally, or be left at the office of the company.

SEC. 7. Repealing Clause. That all laws or parts of laws contrary to or in conflict with the provisions of this act be and the same are hereby repealed, and that this act shall be in full force and effect from and after its passage.

Act 37, E. S. 1877, Sec. 9, gives to Hospital all fines collected for violation of act (inspection of oil) in Shreveport, printed under title "Inspection."

Act 66 of 1894 gives to Hospital one-half of fines imposed on persons who effect marine insurance in companies which have not complied with laws, printed under title "Insurance Companies."

CIVIL RIGHTS.

456. Discrimination Because of Color, etc., Prohibited.All persons engaged in this State in the business of common carriers of passengers shall have the right to refuse to admit any person to their railroad cars, street cars, steamboats or other water craft, coaches, omnibusses, or other vehicles, or to expel any person therefrom after admission, when such person shall, on demand, refuse or Leglect to pay the customary fare, or when such person shall be of

infamous character, or shall be guilty, after admission to the conveyance of the carrier, of gross, vulgar or disorderly conduct, or shall commit any act tending to injure the business of the carrier, prescribed for the management of his business after such rules and regulations shall have been made known; Provided, Said rules and regulations make no discrimination on account of race or color, aud they shall have the right to refuse any person admission to such conveyance when there is not room or suitable accommodations; and except in cases above enumerated, all persons engaged in the business of common carriers of passengers are forbidden to refuse admission to their conveyance, or expel any person therefrom whomsoever (Act 69, 1869, 57).

AN ACT to protect the civil rights of citizens, declaring certain forfeiture for acts in derogation of such rights and directing proceeding to that end, making certain acts in violation of civil rights a misdemeanor and declaring the punishment therefor.

SECTION 1. That every citizen of Louisiana and every citizen of the United States residing in Louisiana, shall have and enjoy equal and impartial accommnodations, advantages, facilities and privileges from all common carriers on land or water, from inn-keepers and from all public places of resort licensed by the State or by any municipal corporation.

SEC. 2. That if any common carrier within the State, whether on land or water, shall make any discrimination against any citizen of the State or of the United States on account of race or color, or shall otherwise conspire to deprive any citizen of any civil rights, immunities or privileges, such common carrier, whether a corporation or an individual, shall be liable to an action for damages in favor of the party injured. Moreover, such common carrier so offending shall forfeit the license which may have been issued in its or his favor. If such common carrier be a corporation, the act of any authorized agent so offending shall be deemed an act of the corporation within the meaning of this law. If any inn keeper, or owner or manager of any public place of resort shall deprive any citizen of any civil right, immunity or privilege guaranteed to him by the constitution of the United States, or of this State, or if any such inn keeper, or owner, or manager aforesaid shall refuse equal and impartial accommodations to any citizen on account of the race or color of such citizen, such inn keeper, or owner, or manager of such licensed place of public resort shall forfeit his license issued to him by the State, and shall not thereafter pursue such calling, and shall likewise be liable to such citizen so injured for damages.

SEC. 3. That it shall be, and is hereby made the duty of the Attorney General of the State, upon the complaint of any citizen that he has been deprived of any civil right, immunity or privilege, or has been refused equal and impartial accommodations by any common carrier, inn keeper or other licensed owner or manager of any public place of resort, to take proceedings in the name of the State, before any civil court of competent jurisdiction, to forfeit the license of such common carrier, inn keeper, or owner, or manager of any place of publie resort so offending. The proceeding to be taken by the Attorney General shall be tried by preference.

SEC. 4. That if any agent or employe, railroad company or steamboat, or other common carrier, running from other States into this State, shall attempt to make or enforce any rule or regulation discriminatiug against any citizen of this State on account of race or color, such agent or employe shall be deemed guilty of a misdemeanor, and shall be arrested, and upon conviction shall be fined or imprisoned at the discretion of the court, or both.
