For the relief of School District Number Five, in Eaton township, Lorain county, and for School District Number Five, in Cæsar's Creek township, in Greene county."

WHEREAS, the district clerk of school district number five, in Eaton township, in Lorain county, returned, according to law, for the year one thousand eight hundred and forty-four, to the township clerk of said township, the enumeration of the youth in said district entitled to the privileges of common schools therein, and the township clerk of said township neglected to return the same to the auditor of the said county, and is irresponsible, and has absconded from the state; and whereas, the district clerk in school district number five, in Cæsar's Creek township, in Greene county, returned, according to law, a like enumeration of such youth in his district, for the same year, to his township clerk, who, by accident, returned to the auditor of said last mentioned county only part of said enumeration; therefore,

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the auditor of Lorain county be, and he is hereby authorized and required to apportion to school district number five, in Eaton township, in said county, out of the proper school funds subject to distribution in said county, in addition to the sum such district may be entitled to at the time of making the next regular distribution, such sum of money as said district would have been entitled to for the year one thousand eight hundred and forty-four, if a return of the number of youth in said district for said year had been properly made; and in making the apportionment hereby authorized, the auditor of said county shall take as a basis for such apportionment, the return made by the district clerk of said district number five to the clerk of said township for the year one thousand eight hundred and forty-four, for which purpose the clerk of said district is hereby authorized and required to make and return to the auditor of said county, a certified copy thereof.

SEC. 2. That the auditor of Greene county be, and he is hereby authorized to add to the list of youth returned as in school district number five, in Cæsar's Creek township, Greene county, for the year one thousand eight hundred and forty-six, any number that he shall find to have been omitted by accident or mistake, in the return of youth in said district for the year one thousand eight hundred and forty-five, so that said district shall receive the same apportionment of school funds as if said mistake had not oecurred.

AN ACT

To incorporate the Baldwin Institute, of Middleburg, Cuyahoga county.

WHEREAS, Mr. John Baldwin, of Middleburg, Cuyahoga county, Ohio, has made a generous donation to the North Ohio Conference of the Methodist Episcopal Church, for the cause of education, consisting of land, and a suitable building thereon, for a seminary of learning; and whereas, said conference have accepted the said donation, and intend establishing there an institution for the promotion of general education; therefore, SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That Thomas Thompson, William Runnells, Wesley J. Wells, William C. Pierce, Wesley Brock, Lorenzo Warner, Holden Dwight, John Baldwin, Alfred Holbrook, Lonson Brown, Horace F. Adams, Ancil J. Pope and Isaac Ward, and their successors, be, and they are hereby created a body politic and corporate with perpetual succession, by the name and style of the Trustees of the Baldwin Institute; that, by their corporate name aforesaid, they may contract and be contracted with, sue and be sued, plead and be impleaded in any court of competent jurisdiction, in any manner of action whatsoever, may have a common seal, may change or renew the same at pleasure, and shall hold their offices until their successors are appointed. SEC. 2. That the successors of the above named trustees, shall be appointed by the North Ohio Conference of the Methodist Episcopal Church, or by such conference of said church as may hereafter include said institution within its bounds.

SEC. 3. That said trustees and successors shall be capable of receiving, acquiring and holding by gift, grant, purchase or otherwise, any estate, real, personal or mixed, to the amount of three thousand dollars, of annual income, may sell, dispose of and convey the same, provided such property be not diverted from the express will of the donor.

SEC. 4. The said trustees shall have power to establish an institution of learning, with a male and female department; elect all the members of the faculty thereof, except the president or principal, who shall be appointed by the aforesaid conference; prescribe the course of study; make all rules, regulations and by-laws which they may deem expedient for the government of the said institution; and transact all business of said corporation: Provided, the same be not inconsistent with the laws and constitution of this state or of the United States.

SEC. 5. A majority of the board of trustees, at any regularly called meeting, shall constitute a quorum for the transaction of business.

SEC. 6. The trustees shall have power to elect, from their own number, a president, secretary and treasurer, who shall perform the duties severally pertaining to their offices.

SEC. 7. That any future legislature may alter or amend this act: Provided, that the title of any property acquired or conveyed, under its provisions, shall not be affected thereby, nor diverted from the literary, scientific and benevolent purposes originally designed.

AN ACT

To incorporate St. Steven's Chapel, in Delhi township, Hamilton county.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That Michael Gorman, John Gerdeison, and David Zoller, be, and they are hereby created a body corporate and politic, by the name of St. Steven's Chapel, in Delhi township, Hamilton county, Ohio.

SEC. 2. That the church named in the preceding section, shall be entitled to all the rights, privileges and immunities, and be subject to all the restrictions of an act entitled "an act in relation to incorporated religious societies," passed March fifth, one thousand eight hundred and thirty-six ; and also to the act entitled "an act securing to religious societies a perpetuity of title to lands and tenements conveyed in trust for meeting houses, burying grounds, and residences for preachers," passed January third, one thousand eight hundred and twenty-five.

SEC. 3. That said corporators shall give ten days' notice of their first meeting under this act, by advertisement in three public places in the vicinity of said church.

AN ACT

To repeal part of an act entitled "An act to provide for the better regulation and improvement of the Moravian State Road, from Cadiz, in Harrison county, to Uricksville, in Tuscarawas county," passed March 8, 1845.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the fourth, fifth, sixth and eighth sections of the act to which this is an amendment, are hereby repealed.
