be deposited with the controller. But no person or corporation shall be accepted by said board of finance as a surety on such bond except as authorized in section 159 of this charter. The assistant clerks shall each have all the powers and may perform all the duties of the clerk, subject to his direction.

SEC. 27. This act shall take effect from its passage.

AN ACT CONSOLIDATING THE TOWN AND CITY GOVERNMENTS OF NEW BRITAIN AND REVISING THE CHARTER OF THE

CITY OF NEW BRITAIN.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

CITY LIMITS.

SECTION 1. All of the inhabitants, being electors of this state, dwelling in the town of New Britain, being the community hitherto incorporated and known under the name of the city of New Britain, together with the inhabitants of that part of the town of New Britain not hitherto within the limits of said city, are hereby constituted and declared to be and remain forever one and the same body politic and corporate, by the name of the city of New Britain; to have perpetual succession; to be one person capable of suing and being sued, pleading and being impleaded in all suits whatsoever, and of purchasing, holding, and conveying any estate, real and personal; to have a common seal with power to change the same; and to hold and exercise such powers and privileges exercised by said city as are perpetuated herein, together with all the additional powers and privileges herein and hereby conferred.

SEC. 2. All the property and rights of action and all securities and liens therefor, including liens for taxes, of the town of New Britain are hereby transferred to and vested in said city of New Britain, and said city is hereby and by the acceptance of this act made liable for all debts, dues, and obligations of every kind of said town of New Britain now due or hereafter to become due, and shall perform all the duties and have and exercise all the rights of said town, and any person having any claim or right of action against the said town of New Britain may enforce the claim against the said city of New Britain in the same manner as if said claim or right of action had originally accrued against said city of New Britain. The present officers of said town, at the expiration of their respective terms of office, shall turn over to the corresponding officers appointed under this act all property of said town in their possession, and shall execute all papers necessary for a complete transfer of title. All sums of money,

by whomsoever payable, which but for the provisions of this act would be paid to the town treasurer, shall, when this act takes effect, be payable to and receivable by the treasurer of the city of New Britain.

TAXATION.

SEC. 3. Said city, for the purpose of taxation, is hereby divided into two districts. The first taxing district shall comprise all the territory within the limits of the city of New Britain as set forth in section one, being the limits of the town of New Britain. The second taxing district of said city shall comprise all that portion of territory of the city of New Britain lying within the limits hereinafter set forth, viz.: Beginning at a stone monument at the northwest corner of the present city; thence running easterly on the present north city line nine thousand nine hundred (9,900) feet to a stone monument at the present northeast corner of the city; thence continuing easterly in the same straight line twenty-eight hundred and fourteen (2,814) feet, more or less, to a stake or monument in the west line of the town of Newington; thence southerly along the west line of said town of Newington four thousand four hundred and forty-nine and one-half (4,4491) feet to an old monument; thence southerly in nearly a straight line on the said west line of the town of Newington six hundred and fifty-nine and one-half (659) feet to a stone monument on the south side of the highway known as Newington road; thence continuing southerly in nearly a straight line eighteen hundred and sixteen (1,816) feet along the said west line of the town of Newington to a stone monument; thence southerly in nearly a straight line on the said west line of the town of Newington twenty-one hundred and forty-five (2,145) feet to a stake or monument; thence westerly nearly at right angles with the last mentioned line four thousand two hundred and forty-six and one-half (4,2461) feet to a stake or monument, said last mentioned line being parallel to and two hundred (200) feet south of the south line of Rutherford street; thence southerly, parallel to South Stanley street and two hundred (200) feet from the east line of said street, three hundred and ninety-two and two-tenths (392.2) feet to a stake or monument; thence southeasterly, parallel to the east line and two hundred feet therefrom, two hundred and fifty-seven and seven-tenths (257.7) feet to a stake or monument; thence southerly, parallel to and two hundred (200) feet from the east line of South Stanley street, eleven hundred and sixty (1,160) feet to a stake or monument; thence southwesterly, parallel to and two hundred (200) feet from the east line of said South Stanley street, six hundred and eighty and one-half (680) feet to a stake or monument; thence southerly, parallel to and two hundred (200) feet from the east line of said South Stanley street, three hundred and fifty-four and eight-tenths (354.8) feet to a stake or monument, said stake or monument being situated fifty feet south of the highway known as South street; thence westerly, parallel to the south line and fifty feet

therefrom, a distance of three hundred and five (305) feet to a point in the center of the right of way of the New Britain branch of the New York, New Haven, and Hartford Railroad Company; thence southerly, along the center line of said right of way of said railroad company, a distance of twelve hundred and seventy (1,270) feet, more or less, to the north line of the town of Berlin; thence westerly, along the north line of the said town of Berlin, seven thousand three hundred (7,300) feet, more or less, to a stone monument at the present southeast corner of the city limits; thence westerly in a continuous straight line four hundred and twenty-nine (429) feet to a stake or monument, said monument last mentioned being situated two hundred (200) feet west of the west line of Lincoln street extension; thence northerly, parallel to and two hundred feet from said west line of said Lincoln street, six hundred and eighty-three (683) feet to a stake or monument; thence northerly in nearly a straight line, parallel to and two hundred (200) feet from the west line of said Lincoln street, ten hundred and forty-five and three tenths (1,045.3) feet to a stake or monument; thence northerly in nearly a straight line, parallel to and two hundred (200) feet from said west line of said Lincoln street, eight hundred and thirty-eight and nine-tenths (838.9) feet to a stake or monument; thence northerly in nearly a straight line, parallel to and two hundred (200) feet west of said west line of said Lincoln street, seventeen hundred and twenty-nine and eight-tenths (1,729.8) feet to a stake or monument, said last mentioned stake or monument being two hundred feet south of the extension of the south line of Hart street; thence westerly, parallel to and two hundred feet from the extension of said south line of said Hart street, fifteen hundred and seven and eight-tenths (1,507.8) feet, more or less, to a stake or monument, said last mentioned stake or monument being located eighteen hundred (1,800) feet westerly of the present city line; thence northerly, parallel to and eighteen hundred (1,800) feet from the present city line, thirty-six hundred (3,600) feet to a stake or monument; thence easterly, at right angles to the last mentioned line, eighteen hundred (1,800) feet to a stake or monument in the present city line; thence northerly, along the present west city line, about four thousand four hundred and eighty (4,480) feet to the place of beginning.

SEC. 4. All the inhabitants and property within the limits of the first taxing district shall be liable to taxation to defray the burdens and expenses imposed upon said city by this act to the same extent as they would be liable if said burdens, duties, and powers had not been transferred from said town to said city, and in addition thereto for the expenses of the board of health of said city and of police protection outside of said second taxing district, which expenses shall be ascertained, determined, and estimated each year in the month of March by the common council. All other burdens and expenses of said city shall be defrayed by taxation within the limits of the second taxing district. It shall be the duty of the assessors and board of relief of

said city to indicate in the compilation of the grand list for 1905, and annually thereafter, what property is taxable by said city in each of said taxing districts; and the public money derived from the taxation of the inhabitants of said second taxing district exclusively shall not be expended for any purpose for which the money of said city could not lawfully be expended at the time of the passage of this act.

SEC. 5. The town of New Britain is hereby exempted from the operation of existing laws of this state requiring money to be paid to towns, or to the treasurer or other officers of towns, or to state or county treasurers; and in said town all such moneys shall be paid to the treasurer of the city of New Britain, and all state, city, county, and town officers or other persons or corporations who are now required by law to pay money to towns or treasurers or other officers of towns are hereby authorized and directed to pay to the treasurer of the city of New Britain all money to which the town of New Britain would be entitled had this act not been passed.

ESTIMATES AND APPROPRIATIONS.

SEC. 6. The common council shall, in the month of March in each year, at least thirty days before the annual meeting of said city of New Britain, make an estimate of the amount of money required for the several departments of said city for the ensuing year, giving details so far as the same may be practicable, with the estimated receipts for said year. All moneys received from the state, county, other towns, individuals, or corporations, which but for the passage of this act would have been paid to the town of New Britain, shall be shown and used as estimated receipts of the first taxing district. Said common council shall recommend to the city meeting such tax rates for each district as it shall deem proper, and said common council shall cause such estimates and recommendations to be published in each daily newspaper published in said city, and shall submit the same. to the annual city meeting. Said city meeting shall thereupon take action on said recommendations and make such appropriations as may be necessary, and shall adopt such rates of taxes in each of said taxing districts as may be necessary to provide for such appropriations so made at said meeting; but the amount appropriated shall not be greater than the estimated receipts, including taxes laid at said meeting. It shall not be lawful for the common council to make appropriations from the city treasury, or in any manner bind said city for any sum in excess of the estimate so approved, altered, or amended by said city meeting. Any additional appropriations voted at any special meeting shall also be provided for by a tax at said meeting, except in such cases as are by this act provided for by the issuance of bonds. The mayor or any executive officer of said city shall be held personally responsible and liable for the amount of any order drawn or obligation given in violation of this section.

SEC. 7. All taxes hereafter laid by said city shall be laid by

said city meeting on the grand list of said city made next before or next after the time of said meeting.

WARDS.

SEC. 8. The city of New Britain shall be divided into six wards, and said wards shall be voting districts at all electors' meetings to be holden in the town of New Britain. Said wards are designated and bounded as follows, viz.:

FIRST WARD LIMITS.

So much of said city as lies southerly and westerly of a line commencing at the western limit of said town and in the center of the Mountain road, so-called; thence running easterly in the center line of said Mountain road to the center of Southington turnpike, so-called; thence southerly on the center line of said Southington turnpike to the center of Hart street; thence easterly on the center line of said Hart street to the center of Arch street; thence northerly on the center line of said Arch street to the center of Main street; thence southeasterly along the center line of said Main street to the center of South Main street; thence southerly on the center line of said South Main street to the southern limit of said town, shall constitute and remain the first ward.

SECOND WARD LIMITS.

So much of said city as lies easterly and southerly of a line commencing at the southern limit of said town, at the same point heretofore described as the point where the boundary of the first ward ends; thence running northerly on the eastern boundary line of said first ward to the center of Park street; thence easterly on the center line of said Park street continuing in a straight line to the center of East street; thence easterly on the center line of Belden street continuing in a straight line to the eastern limit of said town, shall constitute and remain the second ward.

THIRD WARD LIMITS.

So much of said city as lies northerly, westerly, and southerly of a line commencing at the same point in the western limit of said town heretofore described as the point where the boundary line of the first ward commences; thence running easterly on the northern boundary line of said first ward to the center of Southington turnpike, socalled; thence southerly on the eastern boundary line of said first ward to the center of Hart street; thence easterly on the northern boundary line of said first ward to the center of Arch street; thence northerly along the western boundary line of said first ward to the center of Main street; thence northerly along the center line of said
