convey said person, with such clothing, to said institution. And the said Clerk shall issue a certificate to the Auditor of said county, showing the cost of said clothing, not to exceed twenty (20) dollars, and the cost of conveying said person to such institution, the amount of which certificate shall be allowed and paid by the Board of Commissioners of said county out of such funds as may be available therefor, in the same manner that expenses for clothing and transferring insane people are now paid.

2819b. Woman to be appointed to convey woman. 3. Upon receiving an order to convey such idiotic or feeble-minded woman to such institution, the Sheriff of said county shall procure some suitable woman to convey said idiotic or feeble-minded women to said institution, and if, on account of the character of such idiotic or feebleminded woman, it is necessary to give assistance to such woman in the conveying such idiotic or feeble-minded woman to said institution, it shall be proper for such Sheriff to procure such assistance, and certify the same to the Clerk as a part of the expense of so doing, and no bill for the expense of such conveyance shall be allowed by the Commissioners of any county unless it be accompanied by a certificate of the superintendent of said school, showing that such person has been duly conveyed to the school by, or accompanied by, a woman attendant.

2820. Application to admit under oath. 10. The form of application for admission into the asylum shall be such as the board of trustees may prescribe, and each application shall be accompanied by answers under oath to such interrogatories as the trustees shall by rule require to be propounded.

Quarterly report of progress. admission of an inmate, the superintendent shall cause a descriptive scheme to be made of such child, giving a detailed account of its condition, and he shall require of the principal on the 1st day of July of each year, and on the first of every three months thereafter, to give a written report of each child, showing in what respect it has been improved, which report is to be filed with the descriptive scheme, and is for public inspection, and to be continued for two years and no longer, if the child remains so long in the institution.

2822. Division of scholars by grades. 12. Trustees shall make special provisions that low grade inmates shall not associate with the better and more improved grades, and epileptics shall be kept separate from all other grades as much as possible. 2823. Admission of paying pupils. 13. Any persons who wish to enter a child into said institution for treatment, training, culture or improvement, and pay all the expenses and furnish attendant, may do so under agreement, rules and regulations prescribed by the superintendent and approved by the trustees. Under this section adults may be admitted under rules adopted by the trustees, if their entire support and maintenance is provided for by some friend or other person.

2824. Trustees ad interim. 14. Immediately on the passage of this act, the Governor shall appoint three trustees, to hold office until the following first day of April, and then the appointment shall be made as in section 2 provided.

2825. Cost to private pupils. 15. In cases of admission on application of parent and guardian without special agreement, such parent, if able, and such guardian, if child has sufficient estate, shall pay the sum of $150 per year in quarterly payments, in advance, and furnish all necessary clothing or such less amount as the board of trustees may order such party to pay, after making the proper investigation of the financial standing of such parent or ward.

2826. Transportation of children- Payment of. 16. The expenses of the transmission of children to and from the asylum, supported wholly or in part by the State, shall be paid by the County Commissioners. of the county from whence sent; in other cases at the expense of the applicant.

2827. Purchase of land-Erection of buildings. tees are hereby authorized to purchase, for the use of said institution, suitable land at or near the city of Fort Wayne, in Allen county, Indiana, not to exceed eighty acres, at a cost not to exceed $10,000. Said trustees, after ascertaining said real estate not to be subject to any lien or incumbrance, are authorized to pay therefor such price as may be agreed upon by and between said board and the owner or owners of said real estate, not exceeding the sum of $10,000, and to take a deed of conveyance of said real estate in fee simple, executed by said owner or owners to said board in its corporate name, for the use of the State of Indiana. Upon presentation to the Auditor of State of the certificate of said board, showing such purchase, and the amount of the purchase money so agreed upon, he shall draw his warrant upon the Treasurer of State, in favor of the treasurer of said board, for such amount, which warrant shall be paid out of any moneys in the State Treasury not otherwise appropriated. There is hereby appropriated, out of any moneys in the State Treasury not otherwise appropriated, the sum of $50,000, or so much thereof as may be necessary, to be used under the direction of said board for the purpose

of purchasing said real estate and in erecting suitable buildings on said land, and in furnishing the same, when so purchased and conveyed, for the use of said school. No more than the sum of $50,000 shall be expended for the purchase of grounds, the construction of buildings, furnishing and equipping said institution ready for occupancy, and the plan adopted for said building or buildings shall be such as can be completed and equipped, ready for occupancy, at a cost not to exceed $50,000, for lands, buildings and equipments.

2828. Trustees' meetings-Reports. 18. Said trustees shall meet as often as may be necessary for the proper discharge of their duties, but they shall hold at least one meeting at said school every month. At all meetings of the board two members shall constitute a quorum, Said board shall make such orders, rules and regulations as will carry into effect the provisions and purposes of this act. On the 31st day of October, of each year, said trustees shall make a full and detailed report of their acts as such, and of the condition of said school, the receipts and expenditures thereof, the number of employes, indicating the duties of each of them, the number of pupils, indicating their ages and sex and showing how they are cared for and instructed, and making such suggestions and recommendations as to said trustees may seem proper; which report shall be filed in the office of the Secretary of State, and shall be printed for public information. 2829. Trustee not to be pecuniarily interested. 19. A person appointed and qualified as a member of said board shall not be eligible to any other office or place connected with said institution during the term for which he or she shall have been appointed, and a trustee or other officer or employe of said institution shall not be personally interested pecuniarily in any contract relating to the providing of any building, grounds, materials, supplies, or any article for said school.

2830. Power to receive devise, etc. 20. Said board shall have authority to receive, for the use of said institution, gifts, legacies, devises and conveyances of property, real or personal, that may be made, given or granted to or for said institution, or in its name or in the name of said board.

2831. Precautions against fire. 21. Said trustees shall cause all property of said institution liable to be destroyed by fire to be kept insured in responsible insurance companies, and shall cause to be provided, and kept in good repair, necessary and proper appliances for the prevention and extinguishment of fires, and proper fire escapes.

2832. Application for admission-Essential facts and verification. 22. Said board shall receive as pupils of said school for feeble minded youths, residents of this State, under the age of eighteen years,

who shall be incapable of receiving instruction in the common schools of this State. Said board shall prescribe and cause to be printed instructions and forms of application for the admission of such pupils, and shall include therein interrogatories, to which they shall require answers under oath, showing such facts as may be needed for the information of said trustees. Such printed instructions and forms shall be furnished to all applicants for the admission of persons as pupils of said school. The application for the admission of any person as a pupil shall be approved by the Board of Commissioners of the county in which he or she may reside at the time of the making of the application. 2833. County Commissioners' duty-Expenses, how paidPupils' cost, how collected. 23. The Board of Commissioners of a county, in approving an application for the admission of a person as a pupil of said school, shall state whether or not such child has an estate of sufficient value, or a parent or parents of sufficient financial ability, to defray the expense, in whole or in part, of supporting such child in said institution, and if there be such means of support in part only, then the amount per month which the parents or parent or the legal guardian of such child may be able to pay; and the person or persons who make the application for such admission shall therein make statement under oath, as to such means of support. Said board of trustees, in accepting an application for the admission of any person as a pupil, shall fix the amount, if any, which shall be paid for such support, according to the ability of the parents or parent of the pupil, or according to the value of such pupil's estate, if any, and shall require payment for such support, so far as there may be such ability to pay, as a condition to the admission or the retention of said pupil. Said amount may, at any time, be changed by said trustees, according to their information concerning such means of support. The superintendent shall receive such payment from parents or guardians, and shall account to said board therefor,and pay over to said treasurer all sums so received, which shall be used as a portion of the fund for the current expenses of said institution. At the end of each month the superintendent shall make and deliver to the treasurer of said board a certificate showing the number of pupils and resident officers and employes of said institution for such month, and upon said certificate said treasurer shall indorse his statement, showing the surplus, if any, of money theretofore received by him for current expenses and not yet paid out or contracted to be paid on account of said school. Upon presentation of such certificate, so indorsed, to the Auditor of State, he shall draw his warrant upon the Treasurer of State, in favor of the treasurer of said board, for an amount equal to fifteen dollars per month for each inmate of said institution as shown by said certificate for such preceding month, less the amount of sur

plus, if any, shown by such indorsement, which warrant shall be paid out of any moneys in the State Treasury not otherwise appropriated. From the moneys obtained as provided in this section shall be paid all the cur rent expenses of said institution, including the salaries of all officers and employes, except the trustees and superintendent of said board: Provided, That there is hereby appropriated out of any moneys in the State Treasury, not otherwise appropriated, the sum of three thousand dollars, or so much thereof as may be found necessary, to meet any deficiency in such current expense fund for and during the next two years. 2834. Temporary building-Removal of inmates. 24. Immedi ately after the appointment and qualification of the trustees first appointed under this act, said board, by contract, shall procure for the use of said school a building or buildings adapted to such use, with suitable grounds, in Allen county, in this State, and at or near the city of Fort Wayne, taking a lease or leases for such premises for and during the period that may elapse before the buildings, the erection and furnishing of which are provided for in section 17 of this act, shall be ready for occupancy by said school, and contracting for the payment quarterly by said board, to the owner or owners of such leased premises, of such rent as may be agreed upon by and between the parties to such lease or leases. Said board shall immediately cause such leased premises to be properly prepared and furnished for such temporary use. For the payment of such rent and for the preparation and furnishing of such leased premises, there is hereby appropriated out of any moneys in the State Treasury not otherwise appropriated, the sum of two thousand dollars, or so much thereof as by said board may be found necessary for such purpose. Said trustees, immediately after their appointment and qualification, shall take charge and control of the feeble minded youths who at that time may be inmates of the Asylum for Feeble Minded Children, at the Soldiers' Orphans' Home, at Knightstown, Indiana, and of all movable property of said asylum, and shall remove said youths and said property to such leased premises, and shall admit to said school, without any application having been made therefor, such of said children as may be found by said trustees to be otherwise entitled thereto, under the provisions of this act; and for each of said children said trustees shall ascertain and fix the amount, if any, that shall be paid for the support in said school of such pupil, according to the ability of the parents or parent of the pupil, or the value of the estate, if any, of the pupil, and shall cause the same to be paid as in case of pupils admitted upon application, as hereinbefore provided.

2834a. Discharge of pupils. 25. Any pupil of said school may be discharged or returned to his or her parents or guardian when, in the judgment of the trustees, it will not be beneficial to such pupil, or will not be
