AN ACT making an appropriation for the completion, construction, improvements to grounds, and repair of certain buildings of the New York state soldiers' and sailors' home at Bath.

Became a law, May 3, 1901, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of forty-six thousand eight hundred and Appropria thirty dollars and fifty cents, or so much thereof as may be necessary, is hereby appropriated out of any moneys in the treasury not otherwise appropriated for the uses and purposes of the New York State Soldiers' and Sailors' home at Bath, as follows: For reconstruction and repairing of the electric plant, ten thousand dollars; for reconstruction and repairs of the steam plant, five thousand dollars, and in addition thereto the unexpended balance amounting to nine thousand, one hundred and thirty-two dollars and seventy-four cents heretofore appropriated for repairs and partial reconstruction of the warming system by chapter three hundred and ninety-five of the laws of nineteen hundred, is hereby reappropriated for the reconstruction and repairing of the steam plant. For the construction of an addition and for the general reconstruction of the boiler house and dynamo rooms, fifteen thousand dollars. For equipment of kitchen and annex, two hundred and fifty dollars; for finishing three cottages, including cess pools, electric fixtures and walks, sixteen hundred dollars; and for installing three kitchen ranges, two hundred dollars or so much thereof as may be necessary. General repairs of sewerage disposal and sanitary equipment nine hundred and fifty dollars; for repairs to barracks H, I and hospital annex, twelve hundred dollars; for general repairs to other buildings, three thousand dollars; for filling and grading grounds around.

§2. The state architect shall prepare the plans and specifications for the board of managers of the institution herein before named and shall supervise and control as architect, all work of construction, additions, alterations or improvements to buildings or plant authorized by this act, and no contract shall be made covering more than one appropriation, unless with the approval of the state comptroller and on the advice of the state architect. The plans and specifications for the work authorized by this act shall be subject to the approval of the board of managers of the institution and of the state board of charities, as provided by law. Work under this act shall be done by contract, except work which in the opinion of the state comptroller and the state architect can be done in whole or in part more advantageously by the employment of inmates and civilian labor or either or both, and the purchase of material in the open market. All expenditures under this act shall be made pursuant to contracts or estimates duly approved by the comptroller, and in the case of construction work by the state architect also, and no item of said appropriation shall be available except for advertising, unless a contract or contracts according to the plans and specification or estimate or estimates therefor, shall have been first made for the completion thereof within the appropriation therefor; and all contracts shall have the performance thereof secured by a satisfactory bond approved by and filed with the comptroller together with a copy of the contract and specifications. When submitting contracts for the approval of the state comptroller, all original bids, with abstract thereof, shall accompany the contract. Moneys herein appropriated shall only be advanced to the board of managers of said institution as the work progresses or the purchase is made and upon bills duly certified, rendered and audited.

§ 3. This act shall take effect immediately.

AN ACT making an appropriation for the quarantine stations at
Hoffman and Swinburne islands.

Section 1. AN ACT to provide for the erection of a suitable monument to the memory of the soldiers of the Thirty-fourth regiment volunteer infantry of the state of New York, who were engaged in the battle of Antietam, and making an appropriation therefor. Became a law, May 3, 1901, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. James A. Suiter, Wells Sponable, Nathan Easterbrook, Junior, Irving D. Clark, Louis N. Chapin, James N. Greene, Jesse R. Fort, John I. Van Etten, Adelbert Perry, C. E. Hayden, J. H. Traver, J. E. Van Court, H. H. Smith are hereby appointed a committee of the surviving members of the Thirty-fourth regiment volunteer infantry of the state of New York, which was engaged in the battle of Antietam, for the purposes hereinafter specified.

§ 2. The committee appointed by and pursuant to section one, of this act, are hereby authorized and directed to erect a monument on the battle field of Antietam, in the state of Maryland, in memory of the soldiers of the Thirty-fourth regiment of volunteer infantry of the state of New York, upon the site which shall have been designated by the said committee as the principal and proper position of such regiment on said battle field; but prior to the erection of such monument, the said committee shall secure the dedication of the ground upon which said monument shall rest, to the memorial purpose for which said monument shall be

erected, with the right of free access thereto by the public, subject, nevertheless, to proper rules and regulations for the protection and preservation of said grounds and the monument to be erected thereon.

§ 3. AN ACT to relieve the congestion and facilitate the traffic on the New York and Brooklyn bridge, and to improve and extend the footpaths, roadways, railway tracks and other facilities for the use of pedestrians, vehicles and railway passengers at the westerly or Manhattan terminal of said bridge.
