For this race the above fourteen horses went to the post to start, the starter having a flag, and a man in advance having one also. The starter dropped his flag, telling the jockies to go; and the flag in front was dropped in the usual manner. The starter, perceiving that four horses were left behind, called to the jockeys to come back, and raised his flag; but the flag in front was not moved from the ground. Two or three horses, including Beverlac, pulled up; but the rest went on, and ran the race through, The Sheriff winning by a head. The starter, who was also the clerk of the course, immediately rode up to the winning-chair and said it was no start. Most of the horses, including The Sheriff, went back to the post with him, and started again; but without any word or signal from the starter, who did not drop his flag, not seeing the man with a flag in front. Beverlac came in first; The Sheriff second. After the second race was run, Lord Spencer, one of the stewards, assisted by Lord William Powlett, called the starter and flagsman before them; and, after hearing their evidence, decided that the first was a good start. The owner of Beverlac objected to this decision, and protested against the stakes being paid over; upon which the stewards agreed to refer the question to the Stewards of the Jockey Club, who decided that the first was a good start. Lord Henley, another of the stewards, not being conversant with the laws of racing, and Mr. Payne, the third steward, having a horse in the race, declined to act. The Publican and Protection did not run the second time.
