Same day, on motion of Mr. Reed and Mr. Porter, the following refolution was twice read, confidered, and adopted, viz:

Resolved, That a committee be appointed to make the neceffary arrangements, previous to the trial of Edward Shippen, Chief Juftice, and Jafper Yeates, and Thomas Smith, affiftant Juftices of the Supreme Court, on charges exhibited, and which fhall be exhibited against them, by the Houfe of Representatives.

Ordered, That Mr. Reed, Mr. Porter, Mr. Mayer, Mr. Hefton, and Mr. Montgomery, be a committee for that purpose.

On motion of Mr. Hart and Mr. Hefton, the letter from the Judges of the Supreme Court, read this day, was again read, and referred to the committee laft appointed.

In Senate, Wednesday, December 12, Mr. Reed, from the committee appointed for that purpofe, made the following report, viz :

The committee appointed to make the neceffary arrangements, previous to the trial of Edward Shippen, Jafper Yeates, and Thomas Smith, Efquires, on charges exhibited, and which may be exhibited againit them, by the Houfe of Reprefentatives, and, to confider and report on their letter of the eighth inftant, report, in part, and offer the following refolution, viz.

Resolved, That the fpeaker be, and he is hereby directed, to iffue procefs, on the application of the managers appointed by the Houfe of Reprefentatives, to conduct the impeachment, exhibited by faid Houfe, against Edward Shippen, Chief Juftice, Jafper Yeates, and Thomas Smith, Efquires, affillant Justices of the Supreme Court of Pennsylvania; or, on the application of the faid Juftices, refpectively, to require the attendance of fuch witnelfes, as either of the faid parties fhall judge neceffary.

On motion of Mr. Reed and Mr. Kean, and by special order, the report, in part of the committee, appointed to make the ne ceffary arrangements, previous to the trial of Edward Shippen, Jafper Yeates, and Thomas Smith, Efquires, was again read, confidered, and adopted.

Whereupon, the fpeaker iffued procefs, agreeably to the application of the Judges, as contained in their letter.

In Senate, January 1, 1805, the clerk of the House of Reprefentatives, prefented an extract from the Journal of that Houfe, a copy of which is as follows:

In the House of Representatives,

"December 31st, 1804.

"Resolved, That the clerk of this Houfe, be directed to offer, to the fpeakers and members of the Senate, the ufe of the chamber of the House of Reprefentatives, during the trial of the article of impeachment, preferred against three of the Judges of the Supreme Court of this Commonwealth."

The committee appointed to make arrangements, previous to the trial of three of the Judges of the Supreme court

Report, That the Senate will organize itfelf, as a Court of impeachment, agreeably to the conftitution, on Monday morning, at ten o'clock, of the feventh inftant, by the following oath or affirmation being adininiftered to the fpeaker and members respectively:

"You do fwear, or affirm, that in all things, appertaining to the trial of the impeachment, against Edward Shippen, Efquire, Chief Juftice, and Jafper Yeates, and Thomas Smith, Efquires, affiftant Juflices of the Supreme Court, you will do impartial juftice, according to the conftitution and laws of this Common

wealth."

That, thereupon, the Court will adjourn, to meet at eleven o'clock, of the fame morning, in the chamber of the Houfe of Reprefentatives, to proceed on the trial of the impeachment, now pending.

That the Senate fhall meet in their chamber, at ten o'clock, in the morning of each day, on Legislative bufinefs; and at eleven in the forenoon, adjourn, to meet in the chamber of the House of Reprefentatives, to attend the trial of the impeach

ment.

That, during faid trial, any motion made by the parties, or their counfel, to the Court, thall be committed to writing, and read by the clerk of the Senate.

If a Senator put a queftion to a witnefs, it fhall be reduced to writing, and put by the fpeaker.

The committee further recommend,

That the proceedings, on the impeachment, be noted and ens tered diftinely from the Journal of Legislative proceedings.

On the 3d of January, 1805, the report of the committee of arrangement was again read, amended as follows, and adopted ;

In place of" If a Senator put a question to a witness, it shall be reduced to writing, and put by the speaker," infert"All questions put to witnesses shall be through the speaker; and, if required by bim, reduced to writing."

In Senate, January 7, 1805, the Speaker laid before the Senate, a letter from Edward Shippen, Efquire, Chief Justice, and Jafper Yeates and Thomas Smith, Efquires, affiftant Juftices of the Supreme Court, a copy of which is as follows:

SIR,

Lancaster, January 7th, 1805.

We have the honor to inform you, that, in obedience to the fummons of the Senate, we attend to answer the article of impeachment, which has been exhibited against us..

It may be proper to apprife you, that Meffrs. Ingerfoll and Dallas will accompany us as counfel, upon this occafion.

In pursuance of the refolution of the Senate of the third inftant, the Senate proceeded to organize itself as a Court of Impeachment.

Mr. Reed was appointed (in conformity with the act of the 19th of March last) to adminifter the oath to the speaker of the Senate, agreeably to the conftitution, and the form adopted by the Senate, and the fpeaker administered, to the members, a fimilar oath or affirmation.

A meffage was received from the House of Representatives, by Mr. Hufton, their clerk, to the following purpose, to wit:

That he was directed to inform the Court, that the chamber of the House of Reprefentatives was ready for the Court to proceed on the trial of the impeachment.

Whereupon, on motion of Mr. Reed and Mr. Hart, the Court adjourned, in purfuance of the faid refolution, to the chamber of the House of Reprefentatives.

JANUARY 7, 1805.

AT about 11 o'clock, the Senate as a Court of Impeach ment, convened in the chamber of the House of Representafives.
