And be it further enacted, That in Veffels buik order to the regiftry of any fhip or veffel, er which, after the laft day of March next, fhall 1793, how be built within the United States, it fhall be register." neceffary to produce a certificate, under the hand of the principal or mafter carpenter, by whom, or under whofe direction, the faid fhip or veffel fhall have been built, teftifying, that fhe was built by him, or under his direction, and specifying the place where, the time when, and the perfon or perfons for whom, and defcribing her built, number of decks and mafts, length, breadth, depth, tonnage, and fuch other circumstances, as are ufually defcriptive of the identy of a fhip or veffel; which certificate fhall be fufficient to authorize the removal of a new veffel, from the diftrict where fhe may be built, to another diftrict in the fame, or an adjoining ftate, where the owner or owners actually refide, provided it be with ballaft only. to keep re Sec. 9. And be it further enacted, That the feveral matters herein before required, having been complied with, in order to the registering of any fhip or veffel, the collector of the Collector district comprehending the port to which the cord of refhall belong, fhall make, and keep, in fome giftry, proper book, a record or regiftry thereof, and fhall grant an abftract or certificate of fuch record or registry, as nearly as may be, in the form following: "In purfuance of an act of the Congress and grant of the United States of America, intitled, certificate "An act concerning the registering and reording of fhips or veffels," [inferting here thereof. the name, occupation, and place of abode, of the perfon by whom the oath or affirmation aforefaid, fhall have been made] having taken or fubfcribed the oath (or affirmation) required by the faid act, and having sworn (or affirmed) that he (or fhe, and if more than one owner, adding the words, "together with," and the name or names, occupation or occupations, place or places of abode, of the other owner or owners) is (or are) the only owner (or owners) of the fhip or veffel, called the [inferting here her name] of [inferting here the port to which the may belong] whereof [inferting here the name of the master] is at prefent master, and is a citizen of the United States, and that the faid fhip or veffel was [inferting here, when and where built] and [inferting here, the name and office, if any, of the perfon by whom the fhall have been furveyed or admeasured] having certified that the faid fhip or vefel has [inferting here, the number of decks] and [inferting here, the number of of regiary. mafts] and that her length is [inferting here, the number of feet] her breadth [inferting here, the number of feet her depth. [inferting here, the number of feet] and that the measures [inferting here, her number of tons] that the is [defcribing here, the particular kind of veffel, whether fhip, brigantine, fnow, fchooner, floop, or whatever elfe, together with her built, and fpecifying whether the has any, or no gallery or head] and the faid [naming the owner, or the master, or other perfon, acting in behalf of the owner or owners, by whom the certificate of admeafurement fhall have been counterfigned, as aforefaid] having agreed to the defcription and admeasurement, above fpecified, and fufficient fecurity having been given, Form of ' certificate according to the faid act, the said ship or vessel has been duly registered at the port of [naming the port where registered.] Given under my hand and feal, at [naming the faid port this [inferting the particular day] day of [naming the month] in the year [fpecifying the num ber of the year, 'in words at length:"] Provided, That if the mafter, or perfon having the charge or command of such ship or vessel, fhall, himself, have made oath or affirmation touching his being a citizen, the wording of the faid certificate fhall be varied fo as to be be varied. conformable to the truth of the cafe: -And How certiProvided, That where a new certificate of re-ficate of regiftry is granted, in confequence of any tranf- giftry may fer of a fhip or veffel, the words fhall be fo varied, as to refer to the former certificate of registry, for her admeasurement. Sec. 11. And be it further enacted, That where any citizen or citizens of the United States fhall purchase, or become owner or owners of any hip or veffel, entitled to be re Citizens veifels out of their trict, how register; arriving at giftered, by virtue of this act, fuch fhip or purchasing veffel, being within any diftrict, other than the one in which he or they usually refide, fuch proper dif- fhip or veffel fhall be entitled to be registered to obtain by the collector of the district, where fuch fhip or veffel may be, at the time of his or their becoming owner or owners thereof, upon his or their complying with the provifions herein. before prefcribed, in order to the registry of fhips or veffels: And the oath or affirmation. which is required to be taken, may, at the option of fuch owner or owners be taken, either before the collector of the diftrict, comprehending the port, to which fuch fhip or veffel may belong, or before the collector of the dif trict, within which fuch ship or vessel may be, either of whom is hereby empowered to adto be deli- minifter the fame: Provided nevertheless, That vered on whenever fuch fhip or veffel fhall arrive withtheir pro- in the district, comprehending the port to per port to which fuch fhip or veffel fhall belong, the certificate of registry, which fhall have been obtained, as aforefaid, fhall be delivered up to the collector of fuch diftrict, who, upon the requifites of this act, in order to the registry' of fhips or veffels, being complied with, shall grant a new one, in lieu of the firft; and the certificate, fo delivered up, fhall forthwith be returned by the collector who fhall receive the fame, to the collector who fhall have granted it: and if the faid first mentioned certificate of registry fhall not be delivered up, as above directed, the owner or owners, and the master of fuch fhip or veffel, at the time of her faid arrival within the diftrict comprehending the port to which fuch fhip or veffel may belong, fhall, feverally, forfeit the fum of one hundred dollars, to be recovered, with costs of fuit; the collec tor. collector to and the faid certificate of registry shall be thenceforth void. And in cafe any of the matters of fact, in the faid oath or affirmation alledged, which fhall be within the knowledge of the party fo fwearing or affirming, fhall not be true, there fhall a forfeiture of the fhip or veffel, together with her tackle, furniture and apparel, in refpect to which, the fame fhall have been made, or of the value thereof, to be recovered, with cofts of fuit, of the perfon by whom fuch oath or affirmation fhall have been made: Provided always, That if the master, or perfon having the charge or command of fuch fhip or veffel, fhall be within the district aforefaid, when application fhall be made for registering the fame, he fhall, himself, make oath or affirmation, instead of the faid owner, touching his being a citizen, and the means whereby, or manner in which, he is fo a citizen; in which cafe, if what the faid mafter, or perfon having the faid charge or command, fhall fo fwear or affirm, fhall not be true, the forfeiture aforefaid fhall not be incurred, but he fhall, himself, forfeit and pay, by reason thereof, the fum of one thousand dollars. chafed by Sec. 12. And be it further enacted, That Veffels pur when any fhip or veffel, entitled to be regif- agents how tered, pursuant to this act, fhall be purchafed registered by an agent or attorney for, or on account of a citizen or citizens of the United States, fuch fhip or veffel, being in a district of the United States, more than fifty miles diftant, taking the neareft ufual route by land, from the one comprehending the port to which, by virtue of fuch purchase, and by force of this act, fuch fhip or veffel ought to be deemed to belong, it thall be lawful for the collector of the dif trict, where fuch fhip or veffel may be, and he |
