stock have power to make assessments, from time to time, on the stock to the extent, in the aggregate, of its face value; and any such telephone company may, by resolution adopted by a majority vote of its outstanding capital stock, at its annual meeting or at a special meeting called in accordance with its by-laws, increase its capital stock. Such increase shall become effective upon the filing, within thirty days after the adoption of said resolution, in the office of the secretary of state for the State of Indiana of an authenticated copy of said resolution. Such copy shall be filed by the secretary of state upon the payment to him of a fee of $25 for said filing; and, upon the issue of such stock, the fees provided for by section 96 of "An act concerning public utilities, creating the public service commission, abolishing the railroad commission of Indiana, and conferring the powers of the railroad commission upon the public service commission," approved March 4, 1913, shall be paid. Any such telephone company may also, in its by-laws, determine the manner in which the stock of the company shall be held and assigned.

Emergency.

SEC. 2. Whereas an emergency exists for the immediate taking effect of this act, therefore the same shall take effect and be in force from and after its passage.

CHAPTER 17.

AN ACT to amend sections 1, 2 and 3 of an act entitled "An act to amend sections 1, 2 and 3 of an act entitled 'An act for the advancement of agriculture, providing for research and investigation in connection with the production of farm products and stock raising and making an annual appropriation therefor,' approved March 3, 1905, and declaring an emergency," approved March 8, 1909, and providing for the annual levy of a tax for the use of the agricultural experiment station.

Agricultural Experiment Station-Tax Levy.

SECTION 1. Be it enacted by the general assembly of the State of Indiana, That section 1 of the above entitled act be

amended to read as follows: Section 1. There shall be levied and collected upon the taxable property of the State of Indiana for the year 1921, and for each year thereafter, for the use of the agricultural experiment station of Purdue university, a tax of two-fifths cent on each one hundred dollars ($100) taxable property in Indiana, to be levied, collected and paid into the treasury of the State of Indiana, in like manner as other state taxes are levied, collected and paid, and the same shall be paid in equal quarterly installments, the first of each quarter, to the treasurer of Purdue university, the same to be expended under the direction of the director of the agricultural experiment station, in providing the necessary equipment and paying the expenses of conducting investigations or making experiments, and otherwise acquiring information and disseminating said information by means of publications, lectures and otherwise, bearing on the production, manufacture, preparation, use, distribution and marketing of agricultural products, and on the development and improvement of agriculture and country life: Provided, That any portion of the fund derived from the levy herein provided for, which shall be unexpended at the expiration of any fiscal year, shall not lapse or be covered into the state treasury, but such unexpended portion, together with accrued interest, shall be available during succeeding fiscal years for the carrying out of the purposes of this act.

Appropriation.

SEC. 2. That section 2 of the above entitled act be amended to read as follows: Section 2. For the purpose of meeting necessary expenditures in carrying on the work outlined in section 1 of this act there is hereby appropriated to the agricultural experiment station of Purdue university out of any money in the treasury of the State of Indiana, belonging to the general fund and not otherwise appropriated, the sum of one hundred and seventy-five thousand dollars ($175,000) for the fiscal year ending September 30, 1921, together with the further sum of one hundred and seventy-five thousand dollars ($175,000) for each fiscal year thereafter, until the funds provided for in section 1 of this act shall become available. Said sums so appro

priated to be payable quarterly upon the first of each quarter to the treasurer of Purdue university.

Advisory Committee.

SEC. 3. That section 3 of the above entitled act be amended to read as follows: Section 3. The work outlined in this act shall be carried out by the agricultural experiment station of Purdue university along lines to be agreed upon by the director of the said agricultural experiment station of Purdue university, and an advisory committee of six persons, one person to be appointed by each of the following organizations of the State of Indiana: The Indiana Federation of Farmers Association, the State Corn Growers' Association, the State Dairy Association, the State Livestock Breeders' Association, the State Horticultural Society, and the State Poultry Association.

Annual Report of Expenditures.

SEC. 32. The director of the agricultural experimental station shall cause to be prepared and printed annually, not less than 500 copies of a detailed statement of the receipts and expenditures of the funds received under the provisions of this act showing the balance remaining at the end of the fiscal year and deposit 250 copies thereof, with the auditor of state for the use of the members of the general assembly-the remaining copies to be for the use of the general public-reference being had to the printed bill.

Emergency.

SEC. 4. Whereas an emergency exists for the immediate taking effect of this act, the same shall be in effect from and after its passage.

CHAPTER 18.

AN ACT providing an annual appropriation to defray the expenses annually incurred by the Department of Indiana Grand Army of the Republic, for printing and stationery.

Indiana Department of G.A.R.-Appropriation. SECTION 1. Be it enacted by the general assembly of the State of Indiana, That the sum of five hundred dollars ($500), or so much thereof as may be required, is hereby appropriated for the fiscal year ending September 30, 1921, and each fiscal year thereafter, to defray the expenses incurred by the Department of Indiana Grand Army of the Republic for printing, stationery and office supplies, the same to be paid out only on bills approved by the assistant adjutant general of the Grand Army of the Republic, for the Department of Indiana.

CHAPTER 19.

AN ACT to amend section 176 of an act entitled "An act concerning municipal corporations," approved March 6, 1905, and declaring an emergency.

Police Pension Fund-Board of Trustees.

SECTION 1. Be it enacted by the general assembly of the State of Indiana, That section 176 of the above entitled act be amended to read as follows: Section 176. In every city of the first, second and third classes, there shall be and is hereby created a police pension fund: Provided, however, That the provisions of this act in relation to such police pension fund shall apply also to cities of the fourth class of this state in case the common council of any city of the fourth class shall elect to establish a board of trustees of such police pension fund. If the common council of any · city of the fourth class shall so elect to establish such board, the common council of such city shall adopt an ordinance to that effect, and upon the adoption of such ordinance

the provisions of this act in relation to such police pension fund and the establishment of a board of trustees to administer the same shall apply to and govern such cities of the fourth class, so far as applicable, the same as in cities of the first, second and third classes.

In cities of the first, second and third classes, and in all cities of the fourth class on the adoption of an ordinance therefor, as aforesaid, such police pension fund shall be governed and managed by a board of trustees, to be composed of not less than seven and not more than nine members, as follows: The mayor, the city treasurer, the chief of police of such city, who shall be ex-officio, members of such board, and not more than six nor less than four members of the police force of such city, who shall be elected at a meeting of the members of the police force of such city, to be held at the central police station on the second Monday in February, 1922: Provided, That in cities of the first, second and third classes, the board of trustees of such police pension fund now in office shall continue in office for the respective terms for which they were selected. In case any city of the fourth class shall adopt the provisions of this act, such meeting shall be held at said central police station on the second Monday thereafter. Two of such trustees so chosen shall hold their offices for one year, two for two years, and two for three years, to be determined by lot among them, and thereafter there shall be selected on the second Monday in February, of each year, two trustees for a term of three years, to succeed those whose terms of office shall expire on such date. And such trustees shall hold their said offices until their successors shall be elected and qualified.

In the event of a vacancy in the office of any of the trustees selected by such police force, as aforesaid, by death, resignation or otherwise, then such police force shall, within a reasonable time thereafter, upon the call of the mayor of such city, hold a special meeting and elect a successor for the remainder of the term of such member. A majority of all such trustees shall constitute a quorum for the transaction of business pertaining to such pension fund. Such trustees shall receive no pay for their services as such, and shall be paid only their necessary expenses: Provided, how
