CHAPTER 897.

AN ACT IN AMENDMENT OF AND IN ADDITION TO CHAP- Passed May 30, TER 94 OF THE PUBLIC STATUTES "OF BIRDS."

It is enacted by the General Assembly as follows:

SECTION 1. Section 4 of Chapter 94 of the Public Statutes of the State of Rhode Island is hereby amended so as to read as follows:

"SEC. 4. Every person who shall take or kill, sell, buy or offer for sale or have in his possession any wood cock from the first day of January to the first day of September; any ruffed grouse or partridge from the first day of January to the first day of September; any quail from the first day of January to the first day of October; any Bartram's tattler or upland plover, commonly known in Rhode Island as grass plover, from the first day of April to the first day of August; any dusky or black duck from the first day of March to the first day of September; any wood duck or summer duck from the first day of March to the first day of September; any blue or green winged teal from the first day of March to the first day of September shall be fined twenty dollars for each of said birds, and every person who shall pursue with intent to kill any of the birds mentioned in this section, within the times wherein the killing of such birds is forbidden shall be fined twenty dollars for each offence."

SEC. 2. Section 6 of Chapter 94 of the Public Statutes of Rhode Island is hereby amended so as to read as follows:

"SEC. 6. Every person who shall at any time of year, take, kill or destroy any quail or partridge, by means of any trap, snare, net or spring, or who shall construct, erect, set, repair, maintain or tend any trap, snare, net, or spring for the purpose of taking, killing or destroying any quail or partridge, or who shall shoot any water fowl by means or by the use of any battery, swivel, punt or pivot gun, shall be fined for each offence, twenty dollars. birds is not prohibited by this chapter, any person may snare on his own land.

SEC. 3. Section 14 of Chapter 94 of the Public Statutes is hereby amended so as to read as follows: "SEC. 14. Every town council and city council shall annually in the month of April appoint not less than one nor more than four suitable persons as special constables, who shall be sworn to the faithful discharge of their duty, and who shall prosecute every person violating the provisions of this chapter, and such special constables so appointed and sworn shall not be required to give recognizance for costs upon making or in the prosecution of complaints under the provisions hereof."

SEC. 4. Any special constable appointed as aforesaid may, without warrant, arrest any person whom he finds in the act of violating any of the provisions of this chapter, or of any act or acts in addition thereto, or in amendment thereof, and may detain them until warrants can be procured against them, and may without warrant seize any birds found in the possession of any person at any time when the killing of such birds is prohibited by law. Provided, that any person so arrested without warrant shall not be detained longer than twelve hours.

SEC. 5. Whenever complaint is made on oath to any magistrate authorized to issue warrants, in criminal cases, that the complainant believes and has reasonable cause to believe, that the laws in relation to birds have been or are being violated in any building or place, such magistrate, if satisfied that there is reasonable cause for such belief, shall issue a search warrant, authorizing any officer competent to serve a warrant, to search such building or place, but no search shall be made after sunset, unless specially authorized by the magistrate upon satisfactory cause shown.

SEC. 6. All acts and parts of acts inconsistent herewith are hereby repealed.

SEC. 7. This act shall take effect immediately upon its passage.

CHAPTER 898.

1890.

AN ACT AUTHORIZING OFFICERS TO DESTROY, OR DISPOSE Passed June 19, OF LIQUOR VESSELS FORFEITED TO THE STATE.

It is enacted by the General Assembly as follows:

SECTION 1. The officers now in custody of any vessels which have been heretofore or may be hereafter forfeited to the state under the provisions of chapter 816 of the Public Laws passed at a special session of the general assembly in July, 1889, are hereby authorized to destroy said vessels or to sell the same at public auction or private sale and to turn over the net proceeds of such sale to the general treasurer.

SEC. 2. This act shall take effect immediately.

CHAPTER 899.

AN ACT IN AMENDMENT OF CHAPTER 257 OF THE PUBLIC Passed June 19, STATUTES "OF FEES AND COSTS IN CERTAIN CASES.

It is enacted by the General Assembly as follows:

SECTION 1. Section 19 of chapter 257 of the Public Jury fees. Statutes is hereby repealed.

SEC. 2. This act shall take effect from and after its

passage.

CHAPTER 900.

AN ACT IN AMENDMENT OF CHAPTER 736 OF THE PUBLIC Passed May 29,
LAWS PASSED AT THE JANUARY SESSION 1889, ENTITLED
"AN ACT TO PROVIDE FOR THE ASSESSING AND COLLECT-
ING OF A POLL TAX."

It is enacted by the General Assembly as follows:

SECTION 1. Section 5 of an act entitled "An Act to Provide for the Assessing and Collecting of a Poll Tax," passed at the January Session, 1889, is hereby amended so as to read as follows:

"SEC. 5. If any person against whom a tax is assessed in accordance with the provisions of this chapter shall neglect or refuse to pay the same for thirty days after the same is due, the collector of taxes shall demand the same of such person with twenty-five cents for the cost of such demand, and if any such person upon whom demand is made as aforesaid shall neglect or refuse to pay such tax together with the cost of making such demand within five days after the date of such demand, then the collector of taxes shall, unless said tax has been remitted as is hereinbefore provided, levy upon the body of such person and commit him to jail in the county of Providence, there to remain until he shall pay such tax and all legal costs including cost of making the demand as aforesaid, or be discharged therefrom in due course of law."

SEC. 2. All acts and parts of acts inconsistent herewith are hereby repealed, and this act shall take effect upon its passage.

CHAPTER 901.

Passed June 19, AN ACT IN AMENDMENT OF CHAPTER 621 OF THE PUBLIC 1890. LAWS, ENTITLED, “AN ACT TO PROVIDE FOR THE APPOINTMENT AND TO DEFINE THE DUTIES OF A COMMISSIONER OF INDUSTRIAL STATISTICS," PASSED MARCH 29, 1887.

It is enacted by the General Assembly as follows:

SECTION 1. Section 3 of an act entitled, "An act to provide for the appointment and to define the duties of a commissioner of industrial statistics," passed March 29, 1887, is hereby amended so as to read as follows: "SEC. 3. Said commissioner shall receive an annual clerk-hire and salary of two thousand dollars, and with the approval of the governor may employ such assistants and incur such expenses incident to the proper discharge of the duties of his office as may be necessary, not exceeding three thousand dollars in amount in any one year, but no such assistant shall be paid more than four dollars per day in addition to his necessary travelling expenses,

and the salary herein provided shall be in addition to the salary provided for the commissioner for the year in which he shall be employed in taking the state

census.

SEC. 2. This act shall take effect on and after its passage.

CHAPTER 902.

AN ACT IN AMENDMENT OF CHAPTER 825 OF THE PUBLIC Passed May 30, LAWS ENTITLED AN ACT MAKING APPROPRIATIONS 1890.
