of any animal affected with any malignant, contagious, or infectious disease, he shall direct the manner in which any such diseased animal shall be disposed of, so as to prevent the spread of any such contagious or infectious disease, and for this purpose may cause any such diseased animal to be killed, and the carcasses to be disposed of at the expense of the owner thereof, in such manner as will prevent the spread of any such disease; but in no event shall any such diseased stock be permitted to be driven or shipped out of any stock yards, except to some rendering establishment, or other suitable place for killing and disposing of such diseased animal as herein before provided for, and then under such regulations and restrictions as may be necessary to prevent the spread of the disease on account of which any such animals have been condemned; Provided, That the owner of any animal or animals ordered to be destroyed by any inspector shall have the right to appeal from any decision of such inspector to the state veterinarian or the state live stock sanitary commission; and during the pendency of such appeal, the condemned animals shall be kept in strict quarantine at the expense of the owner thereof, unless the state veterinarian shall decide such stock is not so diseased, then said expenses shall be paid by the owner of such stock yards; And provided further, That no compensation shall be made by the state to owners of diseased live stock found in the public stock yard, and destroyed as herein provided. The inspector of live stock in any public stock yards in this state shall, on demand of the owner of any live stock passing through any such stock yards, furnish to said owner a bill of health for any live stock by him inspected as hereinbefore required, and found to be healthy. SEC. 23. [Power of commissioners.]-The commissioners shall have the power to call upon any sheriff, under sheriff, deputy sheriff, or constable to execute their orders, and such officers shall obey the orders of said commissioners, and the officers performing such duties as provided by this act shall receive compensation therefor as is prescribed by law for like services to be paid. as other expenses of said commission as hereinbefore provided; and any officer may arrest on view and take before any magistrate of the county, any person found violating the provisions of thi. act, and such officers shall immediately notify the county or district attorney of such arrest, and he shall prosecute the person so offending according to law.

SEC. 24. [Penalty.]-Except as otherwise provided in this act, any person who shall violate, disregard, or evade or attempt to violate, disregard, or evade any of the provisions of this act, or who shall violate, disregard, or evade, or attempt to violate, disregard, or evade any of the rules, regulations, orders or directions of the live stock sanitary commission establishing and governing quarantine, shall be deemed guilty of a misdemeanor, and, upon the conviction thereof, shall be fined in any sum not less than one hundred, nor more than five thousand dollars.

SEC. 25. [Taxes.]-There shall be levied and assessed upon the assessed value of all taxable property in the state in each year, one-tenth of one mill on each and every dollar thereof, to be known as the Live Stock Indemnity Fund Tax; said tax to be assessed and collected in the same manner and at the same time as is now or may be prescribed by law for the assessment and collection of state revenue.

SEC. 26. [Payment into state treasury.]—It shall be the duty of the county treasurer of the several counties to preserve the fund thus provided for as a separate fund, and to transmit the same twice a year to the state treasurer, who shall keep the same in a fund to be known as the "Live Stock Indemnity Fund."

SEC. 27. [Oaths and affirmations.]-For the purpose of this act each member of the live stock sanitary commission is hereby authorized and empowered to administer oaths and affirmations.

SEC. 28. [Quarantine.]—The live stock sanitary commission shall have power to create and enforce quarantine against the disease known as Texas, splenic, or Spanish fever, in any of the counties of this state. In so doing it shall have the power, and, as far as possible, follow the terms of law and requirements of the law creating the commission.

SEC. 29. [Co-operation with general government.]-That the live stock sanitary commission be authorized and directed to co-operate with the commissioner of agriculture of the United States, or any officer or authority of the general government in the suppression and extirpation of any and all contagious diseases among domestic animals, and in the enforcement and execution of any and all acts of congress to prevent the importation or exporation of diseased cattle, and the spread of infectious or contagious diseases among domestic animals.

SEC. 30. [Limitation.]-The liability of the state for carrying out the provisions of this act in any two years is limited by, and shall in no case exceed the amount especially appropriated for that purpose and that period.

SEC. 31. [Acts repealed.]-All acts and parts of acts inconsistent with this act are hereby repealed.

CHAPTER 5.-APPORTIONMENT-LEGISLATIVE.

SECTION 1. [Number.]-That the senate shall consist of thirty-three members, and the house of representatives shall consist of one hundred members. [1881 § 1, chap. 4.]

SEC. 2. [Districts.]-That the state of Nebraska shall be formed into senatorial and representative districts, and senators and representatives shall be apportioned as follows:

SENATORIAL DISTRICTS.

District No. 1 shall consist of the county of Richardson, and be entitled to one senator. District No. 2 shall consist of the county of Nemaha, and be entitled to one senator. District No. 3 shall consist of the counties of Pawnee and Johnson, and be entitled to one senator. District No. 4 shall consist of the county of Otoe, and be entitled to one senator. District No. 5 shall consist of the county of Cass, and be entitled to one senator. District No. 6 shall consist of the county of Douglas, and be entitled to two senators. District No. 7 shall consist of the counties of Douglas and Sarpy, and be entitled to one senator. District No. 8 shall consist of the counties of Washington and Burt, and be entitled to one senator. District No. 9 shall consist of the county of Dodge, and be entitled to one senator. District No. 10 shall consist of the counties of Stanton, Cuming, Madison and Wayne, and be entitled to one senator. District No. 11 shall consist of the counties of Dakota, Dixon, Cedar, Knox, and be entitled to one senator. District No. 12 shall consist of the counties of Antelope, Holt, Wheeler, Pierce, and Valley, and the unorganized territory west of Holt and Wheeler and east of the thirty-first senatorial district, and be entitled to one senator. District No. 13 shall consist of the counties of Platte and Colfax, and be entitled to one senator. District No. 14 shall consist of the counties of Butler and Polk, and be entitled to one senator. District No. 15 shall consist of the county of Saunders, and be entitled to one senator. District No. 16 shall consist of the county of Lancaster, and be entitled to two senators. District No. 17 shall consist of the county of Seward, and be entitled to one senator. District No. 18 shall consist of the county of York, and be entitled to one senator. District No. 19 shall consist of the county of Fillmore, and be entitled to one senator. District No. 20 shall consist of the county of Saline, and be entitled to one senator. District No. 21 shall consist of the county of Gage,

District No. 25 shall consist of the counties of Hamilton and Hall, and be entitled to one senator. District No. 26 shall consist of the counties of Howard, Sherman and Buffalo, and be entitled to one senator. District No. 27 shall consist of the counties of Boone, Nance, Merrick and Greeley, and be entitled to one senator. District No. 28 shall consist of the county of Adams, and be entitled to one senator. District No. 29 shall consist of the counties of Kearney, Harlan and Phelps, and be entitled to one senator. District No. 30 shall consist of the counties of Red Willow, Furnas, Gosper, Frontier, Hitchcock, Hayes, Dundy and Chase, and be entitled to one senator. District No. 31. shall consist of the counties of Dawson, Custer, Lincoln, Keith, Cheyenne and Sioux, and the unorganized territory north of Keith and Lincoln, and be entitled to one senator

REPRESENTATIVE DISTRICTS.

District No. 1 shall consist of the county of Richardson, and shall be entitled to three representatives. District No. 2 shall consist of the county of Nemaha, and be entitled to two representatives.. District No. 3 shall consist of the county of Johnson, and be entitled to one representative. District No. 4 shall consist of the county of Pawnee, and be entitled to one representative. District No. 5 shall consist of the counties of Pawnee and Johnson, and be entitled to one representative. District No. 6 shall consist of the county of Otoe, and be entitled to three representatives. District No. 7 shall consist of the county of Cass, and be entitled to four representatives. District No. 8 shall consist of the county of Sarpy, and be entitled to one representative. District No. 9 shall consist of the county of Douglas, and be entitled to eight representatives. District No. 10 shall consist of the county of Washington, and be entitled to two representatives. District No. 11 shall consist of the county of Burt, and be entitled to two representatives. District No. 12 shall consist of the county of Dodge, and be entitled to two representatives. District No. 13 shall consist of the county of Cuming, and be entitled to one representative. District No. 14 shall consist of the county of Madison, and be entitled to one representative. District No. 15 shall consist of the counties of Stanton and Wayne, and be entitled to one representative. District No. 16 shall consist of the county of Dakota, and be entitled to one representative. District No. 17 shall consist of the county of Dixon, and be entitled to one representative. District No. 18 shall consist of the counties of Cedar and Pierce, and be entitled to one representative. District No. 19 shall consist of the county of Knox, and be entitled to one representative. District No. 20 shall consist of the county of Holt and the unorganized territory west of Holt and east of the fifty-eighth representative district, and be entitled to one representative. District No. 21 shall consist of the county of Antelope, and be entitled to one representative. District No. 22 shall consist of the county of Boone and be entitled to one representative. District No. 23 shall consist of the county of Platte, and be entitled to two representatives. District No. 24 shall consist of the county of Colfax, and be entitled to one representative. District No. 25 shall consist of the counties of Platte and Colfax and be entitled to one representative. District No. 26 shall consist of the county of Butler, and be entitled to two representatives. District No. 27 shall consist of the county of Polk, and be entitled to one representative. District No. 28 shall consist of the counties of Polk, Merrick, and Nance, and be entitled to one representative. District No. 29 shall consist of the county of Saunders and be entitled to three representatives. District No. 30 shall consist of the county of Lancaster, and be entitled to six representatives. District No. 31 shall consist of the county of Seward, and be entitled to two representa

tives. District No. 32 shall consist of the county of York, and be entitled to two representatives. District No. 33 shall consist of the county of Fillmore, and be entitled to two representatives. District No. 34 shall consist of the county of Saline and be entitled to three representatives. District No. 35 shall consist of the county of Gage and be entitled to three representatives. District No. 36 shall consist of the county of Jefferson, and be entitled to two representatives. District No. 37 shall consist of the county of Thayer and be entitled to two represen tatives. District No. 38 shall consist of the county of Nuckolls, and be entitled to one representative. District No. 39 shall consist of the county of Webster, and be entitled to one representative. District No. 40 shall consist of the county of Franklin and be entitled to one representative. District No. 41 shall consist of the counties of Franklin and Webster, and be entitled to one representative. District No. 42 shall consist of the county of Clay, and be entitled to two representatives. District No. 43 shall consist of the county of Hamilton, and be entitled to two representatives. District No. 44 shall consist of the county of Merrick, and be entitled to one representative. District No. 45 shall consist of the county of Hall, and be entitled to two representatives. District No. 46 shall consist of the county of Howard, and be entitled to one representative. District No. 47 shall consist of the county of Adams, and be entitled to two representatives. District No. 48 shall consist of the county of Buffalo, and be entitled to two representatives, District No. 49 shall consist of the counties of Valley, Greeley and Wheeler. and the unorganized territory west of Wheeler and east of the fiftyseventh representative district, and be entitled to one representative. District No. 50 shall consist of the counties of Sherman and Custer and be entitled to one representative. District No. 51 shall consist of the county of Kearney, and be entitled to one representative. District No. 52 shall consist of the county of Harlan, and be entitled to one representative. District No, 53 shall consist of the counties of Harlan and Phelps, and be entitled to one representative. District No. 54 shall consist of the county of Furnas, and be entitled to one representative. District No. 55 shall consist of the county of Red Willow, and be entitled to one representative. District No. 56 shall consist of the counties of Frontier, Gosper, Hitchcock, Hayes, Dundy and Chase, and be entitled to one representative. District No. 57 shall consist of the county of Dawson, and be entitled to one representative. District No. 58 shall consist of the county of Lincoln and the unorganized territory north of Lincoln and south of the twentieth representative district, and be entitled to one representative. District No. 59 shall consist of the counties of Cheyenne, Keith, Sioux, and the unorganized territory north of Keith, and be entitled to one representative.

APPORTIONMENT-CONGRESSIONAL.

SEC. 3. [Division.-That the State of Nebraska be and is hereby divided into three districts for the election af representatives to the congress of the United States, each of which districts shall be entitled to elect one representative and the limits and designations of each district shall be as hereinafter provided. [1882, chap. 3. Took effect Aug. 23, 1882.]

SEC. 4. [First District.]-The counties of Richardson, Nemaha, Pawnee, Johnson, Gage, Lancaster, Otoe, Cass, Saunders, Sarpy and Douglas shall constitute the first district.

SEC. 5. [Second District.]-The counties of Jefferson, Saline, Seward, Butler, Polk, York, Fillmore, Thayer, Nuckolls, Clay, Hamilton, Adams, Webster, Franklin, Kearney, Phelps, Harlan, Furnas, Gosper, Frontier, Red Willow, Hitchcock, Hayes, Chase, and Dundy shall constitute the second district.

SEC. 6. [Third District.]-All that part of the state not included in the first and second district shall constitute the third district.

SEC. 7. [Election.]-The representatives provided for in this act shall be elected in accordance with the laws of the United States.

APPORTIONMENT-JUDICIAL.

SEC. 8. [Ten districts-Two judges in second and third-Practice.]-The state of Nebraska shall be divided into ten judicial districts, as follows: First district: Gage, Johnson, Nemaha, Pawnee, and Richardson counties. Second district: Cass, Lancaster and Otoe counties. Provided, In which said district there shall be two judges of the district court, who shall be elected for the term of and hold their office for four years, from and after the first day of January next succeeding their election. Said judges shall be elected at the general election to be held in November, 1887, and every four years thereafter. Such judges shall have equal power, and shall each perform such duties as are now provided by law, and it shall be the duties of such judges to so divide and arrange the business of said courts between them that the trial of causes may be speedy. To this end it shall be the duty of such judges, by rule of court, to so arrange its terms, its trial dockets, and the empaneling of juries therein, that speedy and exact justice may be accorded to all parties. There shall be drawn in the manner now provided by law, a panel of forty-eight jurors to serve as jurors in such court. Provided, That in any county in said district, when such number of jurors may not be required, the judges may, by appropriate rule, provide for the drawing of a less number. Provided further, That in dividing and arranging the business of said court in said second district, between said judges, court may be held simultaneously in two of the counties of said district. Third district: Douglas, Sarpy, Burt, and Washington counties. Provided, In which district there shall be two judges of the district court, who shall be elected and shall hold their office, shall have equal powers and the same powers, shall divide and arrange the busines of said court, draw and empanel juries in all respects as hereinbefore provided for the judges of said second district. Fourth district: Butler, Colfax, Dodge, Platte, Saunders, Merrick, and Nance counties. Fifth district: Adams, Clay, Fillmore, Jefferson, Saline, Nuckolls, and Thayer counties. Sixth district: Hamilton, Hall, Howard, Seward, York, and Polk counties. Seventh district: Cedar, Cuming, Dakota, Dixon, Madison, Stanton, Knox, and Wayne counties, and the Omaha and Winnebago reservations, and unorganized territory north of Knox county. Eighth district: Franklin, Furnas, Dundy, Hitchcock, Harlan, Kearney, Phelps, Gosper, Red Willow, Frontier, Hayes, Chase, and Webster counties. Ninth district: Antelope, Boone, Greeley, Pierce, Holt, Valley, and Wheeler counties, and the unorganized territory north of Custer and Holt counties and west of Holt and Wheeler counties, and comprised in the new counties of Brown, Cherry, and Loup. Tenth district: Buffalo, Sherman, Dawson, Custer, Keith, Cheyenne, Lincoln, and Sioux counties, and the unorganized territory north of Keith and Lincoln counties and south of the county of Cherry. Provided, That nothing in this section shall be construed to limit, change, or impair the jurisdiction or term of office which the two judges of the third district have or exercise as provided in section one of the act to which this is an amendment. SEC. 9. [Officers in office.]—The judges and district attorneys now in office shall hold their respective positions and perform the duties of their offices in the districts hereby created in which they may reside until the expiration of the term for which they were elected. [1883, chap. XXXVII, sec. 2.]

SEC. 10. [Appointment by governor.]-The governor will appoint a judge to fill the vacancy created by this act, who shall hold his office until the next general election, when such vacancy shall be filled by election in the same manner as such judge is elected in other districts, to hold his office until the general election in 1887, as provided in section one of this act.
