PREFACE.

Ir is the purpose of this work to present the general statute law of Indiana, consisting of the Revision of 1881 as amended, and the subsequent acts of a general, public and permanent nature, so as to exhibit the entire general statute law of Indiana as it now exists, together with appropriate references to, and a digest of, the decisions of the courts construing it.

The order of arrangement is the same as that in the Revision of 1881, it being deemed better to follow an arrangement with which the bench and bar have become familiar from years of use, rather than to adopt any new plan. All statutes expressly repealed have been omitted, and where a section has been amended, the new section is inserted in the place of the old one, with a reference to the amending act. Whenever there has been doubt as to whether a statute is superseded or not, both the old and the new have been inserted, leaving it for the courts to determine which is in force. All new legislation has been inserted and connected with the old statute upon similar subjects in such a way as to make the entire work, as nearly as possible, a harmonious whole.

The wording of the statutes is the same as that found in the Revision of 1881, and the subsequent session acts; and where there are apparent verbal errors in these official publications, we have not felt justified in changing the print.

The section numbers are continuous through the three volumes, and are the numbers which belong to this revision and which are referred to in the indexes and cross references. Following this section number, is given, in ordinary figures, the section number of the Revision of 1881, if the section is a part of that revision. The section number, preceded by E. S., refers to Elliott's Supplement. Following

the section head-lines there is given, in ordinary figures, the original number of the section of each act as a means of readily referring to the various statutes in the places where they first appear, and to assist in identifying the statutes as referred to in the published court decisions.

In the insertion of statutes, the merely formal matters, such as the title and enacting clauses, are omitted. Emergency clauses are also omitted, but the date of the taking effect of each act is given.

The notes of decisions will be found much more extensive than in any former edition of the Indiana statutes. This is largely due to the great number of cases decided, but it is partially due also to the fact that the notes are given a wider scope than has heretofore been attempted. The recent labors of the author in preparing the Indiana Digest have enabled him to make the notes much more complete than would be practicable from an examination of the reports for this work
