shall make a report, at each regular session of the General Assembly, of the condition of the institution, of which there shall be five thousand copies printed-three thousand for the use of the members of the General Assembly, and two thousand for the use of the superintendent.

2805. Appropriations. 22. The General Assembly shall, at each regular session, appropriate a sum necessary to meet the current expenses of the institution until the next regular session thereafter,

2806. Sectarianism. 23. No sectarian tenets of religion shall be taught in such institution to any pupil thereof.

2807. Expense of clothing. 24. In cases of extreme necessity, only, snail clothing be furnished at the expense of the State to any pupil of such institution, and in such case the account therefor, subscribed and sworn to by such superintendent, shall be, by him, transmitted to the Auditor of the county where such pupil shall reside; and upon the receipt of such account, such Auditor shall issue his warrant upon the Treasurer of such county for the amount of such account, which such Treasurer shall transmit orthwith to the Treasurer of State; and such Auditor shall present such account to the Board of Commissioners of such county, at their next session thereafter, when such Board, unless, in their opinion, such pupil or his parents or guardians are unable to pay such account, shall direct such Auditor to collect the same, with ten per centum damages thereon.

2808. Non-resident pupils. 25. Pupils from without the State may be admitted to the privileges of the institution, on the pay ent of such sum as the Board may consider sufficient to defray expenses.

2809. Education free to residents. 20. All mutes of the State shall be entitled to education in the institution free of charge, under such regu lations as to age, capacity, character, and punctual attendance as the board of trustees shall adopt.

2810. Expulsion of pupils. 27. The trustees shall expel from the institution any pupil whose longer continuance in the same would be injurious thereto.

2810a. Power to sell a piece of land. 1. The trustees of the Institution for the Education of the Deaf and Dumb be, and the same are, hereby authorized and empowered to sell and convey to any person or corporation, who may desire to purchase the same, a tract off of the south side of the premises now occupied by said institution, and north of the railway track now operated by the Pittsburgh, Cincinnati and St. Louis. Railway Company, in the city of Indianapolis, not exceeding seven and one-half feet in width, except within two hundred feet of the east end thereof, and no part of said strip of two hundred feet exceeding twentyfive feet in width. Said sale to be made upon such terms as may be agreed to by said trustees, either for cash or in the consideration of the making of suitable improvements upon the remainder of said premises by the party purchasing the same.

2811. School established-Trustees; appointment; term; vacancy; oath; salary. 1. There shall be established and maintained in this State, at or near the city of Fort Wayne, Allen county, Indiana, an institution to be known as the Indiana School for Feeble Minded Youth. The general charge and management of said institution shall be intrusted to a board of trustees consisting of three members, who shall be appointed by the Governor of this State. Said board shall be. a body politic and corporate, to be known as the Board of Trustees of the Indiana School for Feeble Minded Youth, by which name said board may sue or be sued, plead or be impleaded, in any court of this State. One member of said board shall be a woman. The other two members shall be voters of this State, who shall not both be adherents of the same political party, but each shall be an adherent to one of the two political parties casting the greatest number of votes at the general election next preceding his appointment. The first members of said board shall be appointed immediately upon the taking effect of this act. Each member of said board shall hold office, as such, for the term of four years, and until his or her successor shall be appointed and quali fied: Provided, That one of the two male members first appointed, to be designated by the Governor in making the appointment, shall serve for a term of only two years, and until his successor shall be appointed and qualified: Provided, further, That any member of said board may be removed from said office by the Governor at any time for cause, to be stated in the order of removal. Any vacancy in said board shall be filled immediately by appointment by the Governor, and a trustee appointed to fill a vacancy shall hold said office only for the unexpired portion of the term of his or her predecessor; but any trustee shall be eligible to re-appointment at the expiration of his or her term of office. Every trustee, before entering upon duty as such, shall take and subscribe an oath to faithfully and impartially discharge the duties of said office. Each trustee shall be allowed a salary of five hundred dollars per year for the first two years, and three hundred dollars per year thereafter, payable quarterly out of any moneys in the State treasury not otherwise appropriated, which shall be in full for all services as trustee, traveling and other expenses; and no additional sum shall be allowed or paid to said trustee. 2812. Officers-Salaries- Treasurer's bond. 2. Said trustees shall elect one of their number as president of said board, another as treasurer thereof, and a secretary thereof, who may be the third member or a person not a trustee. The secretary shall keep a full and accurate record of all proceedings of said board, in a book or books used for such purpose only. The treasurer, before entering upon duty as such, shall file in the office of the Auditor of State a bond, payable to the State of Indiana, in such sum and with such sureties as shall be approved by the said Auditor, conditioned for the faithful accounting for by said treasurer, and his proper payment of all moneys that shall come into his hands as such. 2813. Purposes of institution. 3. The purposes of this institution shall be to care for, support, train and instruct feeble minded children; the term feeble minded to include idiotic, epileptic and paralytic children. 2814. Dual departments. 4. The institution is to be divided into two distinct departments: one industrial, the other custodial. The industrial department is to be a department for culture, in which shall be placed such feeble minded children who are actually, in a practical sense, capable of improvement, in which the rudiments of a common school education are to be taught in connection with, and subordinate to, culture in manual and industrial occupations. The objective point to be attained in this department is future usefulness, self care and self support. The custodial department shall be an asylum for low grade, feeble minded, idiotic, epileptic children. In this department special attention shall be paid to mental, physical and hygienic treatment.

2815. Superintendent - Duty Bond- Salary. 5. The board. of trustees shall appoint a superintendent for a term of three years, who shall have practical experience in the care and management and education of feeble minded children, whose duty it shall be, under the direction of the board of trustees, to superintend the general affairs of the asylum and manage its finances. He shall give bond to the State of Indiana in such sum as the board of trustees may require, to be approved by the board, conditioned for the faithful performance of his duties, who shall receive an annual salary of $1,500, in quarterly payments. The mental, moral, physical and hygienic treatment, training and culture, shall be under the exclusive direction of the superintendent, who must be an expert in these subjects. He shall make quarterly settlements with the board, and shall be removable by the board on approval of the Governor.

2816. Principal-Matron-Teachers. 6. The superintendent shall appoint a principal and a matron, subject to the approval of the board of trustees, and employ all teachers and such other help as may be needed. The matron and principal must each be persons with experience in the care of feeble minded children.

2817. Principal

Duties-Salary. 7. The principal shall, under the direction of the superintendent, manage the instruction, training and culture of the inmates, as he may be directed, subject to removal by the superintendent. He shall receive an annual salary of $750, payable quarterly. [As amended, 1889 S., p. 130. In force March 6, 1889.

2818. Matron-Duties Salary. 8. The matron shall, under the direction of the superintendent, manage the internal affairs of the institution, with special view to the care and comfort of the inmates, subject to removal by the superintendent. She shall receive an annual salary of $500, in quarterly payments.

2819. Who admitted as pupils.

9. There shall be received into the Indiana School for Feeble Minded Youth, feeble-minded, idiotic, epileptic, and paralytic children under the age of sixteen (16) years, whose admission may be applied for as follows:

First. By the father, if the father and mother are living together. Second. If father and mother are not living together, then by the one having custody of the child.

Third. By a guardian duly appointed.

Fourth. By the superintendent of any county poor asylum or the matron of any county orphanage.

Fifth. By the person having the management of any other institution or asylum where children are cared for,

Under items three, four and five, consent of parents, if living, is not required. All subject to such rules and regulations as the Board of Trustees may adopt. It is further provided that it shall be the duty of the trustees of said institution to set apart a portion thereof, to be known as the custodial department for adult females, and that such institution shall receive into such department such persons as can be properly and conveniently cared for therein, and as are committed thereto in accordance with the provisions of this act. Any person may file in the office of the Clerk of the Circuit Court of any county his verified petition, stating that some woman (naming her) of said county is not being, or can not be, properly maintained or cared for by those who have her in charge; that such woman is a feeble-minded woman; that she is over sixteen (16) and under fortyfive (45) years of age; that she is not insane; that she is not pregnant; that she is idiotic or feeble-minded; that she is in good bodily health; that she is not afflicted with any chronic or contagious disease; that she is a legal resident of the State and county where the application is filed, together with such other statements as may be necessary to show that she is a proper person to be admitted to said

department of said institution, and that her admission thereto would be in conformity to the rules and regulations established by the Board of Trustees of said institution for the admission and care of such persons. That upon the filing of such petition the Clerk of said court shall issue a summons to such persons named in said petition, requiring them to be and appear before said court, or the Judge thereof, at some time to be fixed by said Clerk, not more than ten days thereafter, and shall bring the said matter at once to the attention of the Judge of said court. That the Judge of said court, shall, as soon as convenient, pass upon such petition, first having ascertained that said woman has been served with notice of the filing thereof, and that she is present in court, or that, having had reasonable notice thereof, she is unable to attend the hearing of said matter; and that it shall be the duty of said court to examine such witnesses, among whom shall be at least one physician, as may be necessary to prove the truth or falsity of said petition. And if the court finds that each and all of the allegations contained in said petition are true, and that said woman is a proper person to be cared for in said department of said institution, and that she can be cared for therein, it shall be its duty. to make an order committing the care and custody of said woman to said institution. And it shall thereupon be the duty of the Clerk of said court to make a certified copy of said petition, and of the finding and judgment of said court, and transmit the same to the superintendent of said institution at Fort Wayne, Indiana. When the finding of the court is in favor of said petition the costs of said proceedings shall be allowed and paid by the Board of County Commissioners of said county, and it shall be the duty of the Clerk to include them in the certificate mentioned in Section 2, but if the findings of the court shall be against said petition the costs of such proceeding shall be adjudged against the petitioner. 2819a. Duty of superintendent. 2. Upon receiving such order of commitment for the admission of a feeble-minded or idiotic woman, it shall be the duty of the superintendent of said school, at once, if there shall be room for any more inmates, or as soon thereafter as there shall be room in said institution for such person, to notify the Clerk of said Court that said person will be received when brought to said institution. That with said notice said superintendent shall send a list of such clothing as shall be prescribed by the Board of Trustees of said school, and a blank form of a certificate of health and freedom of exposure to contagious disease at such time. And thereupon said Clerk shall procure such clothing as is required by said institution and issue a warrant to the Sheriff of said county to
