of their duties to the district court within whose district the said drainage district is located, whenever required by law or the order of the said court, and shall execute a bond running to the State of New Mexico to be filed with said clerk for the benefit of the parties interested, in an amount to be fixed by the said district court or presiding judge thereof, with sureties to be approved by the court or presiding judge, conditioned for the faithful discharge of their duties as such commissioners, and the faithful accounting for and application of all moneys which shall come into their hands as such commissioners. A majority shall constitute a quorum, and a concurrence of a majority in any matter within their duties shall be sufficient for its determination.

SEC. 10. That Section 1903, Codification of 1915, New Mexico Statutes, Annotated, be amended to read as follows:

SECTION 1903. Within ten days after said commissioner shall be elected and qualified they shall meet and organize by electing one of their number president and one secretary, and as soon as may be thereafter, they shall personally examine the lands in said district and make a preliminary report to the court, which report shall state:

1. Whether said proposed work is necessary, or would be of utility in carrying out the purposes of the petition.

2. Whether the proposed work would promote agricultural interests, and whether there are any lands described in said petition which would not be benefitted by such improvement.

3. Whether the total benefits from said proposed work will exceed the cost thereof together with the damages resulting therefrom; and in arriving at this they shall include all benefits and all damages resulting therefrom, both within and without said district.

4. Said commissioners shall in said report fix as near as may be and report to the court the boundaries of said proposed drainage district. Said boundaries shall not be so changed from those in the petition as to deprive the court of jurisdiction by reason of not having on the petition the required number of signers owning land within said changed boundaries."

SEC. 11. Section 1895, Codification of 1915, New Mexico Statutes, Annotated, and all other acts and parts of acts in conflict herewith are hereby repealed.

SEC. 12. That it is necessary for the preservation of the public peace and safety of the inhabitants of the State of New Mexico that the provisions of this act shall become effective at the earliest possible time, and therefore an emergency is hereby declared to exist, and this act shall take effect and be in full force and effect from and after its passage and approval.

CHAPTER 157.

AN ACT TO AMEND SECTION 3674 OF THE NEW MEXICO STATUTES ANNOTATED, CODIFICATION OF 1915, RELATIVE TO PAVING PETITIONS.

House Bill No. 372; Approved March 17, 1919.

Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. That Section 3674 of the New Mexico Statutes Annotated, Codification of 1915, as amended by Section 1 of Chapter 40 of the Session Laws of 1915, be and the same is hereby amended to read as follows:

"SECTION 144. Whenever the owners of more than one-half of the front feet of property abutting upon any highway, or portion thereof, proposed to be improved in any city, exclusive of any property owned by the United States, or by the state, shall petition in writing, the governing body thereof, to order the improvement of such highway, or part thereof, within a district described in such petition or petitions, the governing body of such city shall have the power to order such improvement and select the material and methods therefor, and contract for the construction of such improvements in the name of the city, and to provide for the payment of the cost thereof out of any available funds of the city, or as otherwise provided by law; provided, that whenever any proposed improvement herein contemplated shall be on a highway or portion thereof, upon which abutts property belonging to any county, school district or city, the respective boards or bodies having control of such county, school district or city property, may cause a petition to be signed for such improvement."

CHAPTER 158.

AN ACT RELATING TO GATES ON FENCE LINES ON NATIONAL FOREST RESERVES AND LANDS ADJOINING THERETO.

House Bill No. 391 (as amended); Approved March 17, 1919. Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. It shall be unlawful for any person or persons to open and neglect to close, before leaving the immediate vicinity thereof, the gate or gates of any fence on, or enclosing any, lands of the different National Forest Reserves of this State, or to open and fail to close the gate or gates of any fence on the

land of any person, firm or corporation, where the same is situate within the boundaries of, or adjoining, any National Forest Reserve; provided, such gates are so constructed as to be easily. opened and shut.

SEC. 2. Any person or persons failing to comply with the provisions of the preceding section shall be subject and responsible for any damage or trespass caused from such neglect.

SEC. 3. Any person failing to comply with the provisions of this act shall also be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined not less than ten nor more than twenty-five dollars.

CHAPTER 159.

AN ACT REQUIRING THE COUNTY ASSESSORS TO SECURE STATISTICS OF THE PRINCIPAL FARM PRODUCTS AND AGRICULTURAL RESOURCES IN EACH COUNTY IN THE STATE.

House Bill No. 399 (as amended); Approved March 17, 1919. Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. It shall be the duty of the assessor of each county in the State of New Mexico at the time of taking the annual assessment of property to ascertain for each farm and property in the county for which he is assessor, the acreage of each farm crop and such other statistics in relation to the principal farm products and agricultural resources as may be required by the State Tax Commission in cooperation with the Federal Bureau of Crop Estimates, as specified in blanks and instructions furnished by the said Tax Commission, such statistics to be forwarded to said State Tax Commission at Santa Fe, New Mexico, immediately after the assessment is completed and not later than July first.

SEC. 2. The State Tax Commission shall within five days after their receipt forward to the assessors a certificate that the statistical reports from said assessor have been received and appear to be complete and in proper form, or else he shall within the same period return the reports to said county assessor for necessary indicated corrections.

SEC. 3. That it is necessary for the preservation of the public peace and safety of the inhabitants of the State of New Mexico, that the provisions of this act shall become effective at the earliest possible time, and therefore an emergency is hereby declared to exist, and this act shall take effect and be in full force and effect from and after its passage and approval.

CHAPTER 160.

AN ACT DECLARING THE ROAD FROM ESPANOLA, THENCE RUNNING THROUGH SANTA CRUZ, QUARTELES, LA PUEBLA, CHIMAYO, CORDOVA TO TRUCHAS TO BE A STATE HIGHWAY.

Be It Enacted by the Legislature of the State of New Mexico:

SECTION 1. That certain road commencing at Espanola, Rio Arriba county, running thence to Santa Cruz, thence to Quarteles, thence to La Puebla, Santa Fe county, thence to Chimayo, partly in Santa Fe county and partly in Rio Arriba county, thence to Cordova, thence to Truchas in Rio Arriba county, is hereby designated and declared to be a State High

way.

CHAPTER 161.

AN ACT MAKING APPROPRIATIONS FOR THE EXPENSES OF THE EXECUTIVE, LEGISLATIVE AND JUDICIARY DEPARTMENTS, INTEREST AND SINKING FUNDS, PAYMENT OF THE PUBLIC Debt, PUBLIC SCHOOLS AND OTHER EXPENSES REQUIRED BY EXISTING LAWS, DURING THE EIGHTH AND NINTH FISCAL YEARS, AND DEFICIENCIES, AND ADDITIONAL APPROPRIATIONS FOR THE SEVENTH FISCAL YEAR, PROVIDING A TAX, AND PROVIDING FOR THE ISSUANCE OF CERTIFICATES OF INDEBTEDNESS.
