the yeir of God M vi threttie-aught yeris, and off our soveraigne lordis reigne CHARLES, by the grace of God, king of Great Brittaine, France, and Ireland, defender of the faithe, the fourteint yeir, convenit the reverend colledgiatt memberis following, thay ar to say, Mr. Alexander Ross doctor of divinitie, ane of the ordiner ministeris of Godis word at Aberdeine, rector of the said universitie; Mr. Robert Barroun, doctor and professor of divinitie in Aberdeine; Mr. Alexander Scrogie, doctor of divinitie and minister of Godis word at St. Machar kirk of Old Aberdeine; and Mr. Arthour Johnstoun, doctor of phisicke, three of the assessouris; Mr. William Leslie, doctor of divinitie, principall of the said colledge; Mr. James Sandilandes, canonist; Mr. William Gordoune, doctor of medicine, mediciner; Mr. Robert Ogiluie, supprincipall; Mr. Johne Lundie, grammarian; Mr. Alexander Midletoun, Mr. Alexander Gardyne, and Mr. Alexander Scrogie, younger regent; Mr. Gilbert Ross, cantor, and Patrick Innes, sacrist, maisteris and memberis of the samen colledge, withe Mr. Alexander Reid, notter publict, ther clerk.

Sessione prima.

The said day and place, anent the tryell of the said Mr. Johne Lundie, his alledgit commissione or power of agentrie to the generall assemblie of the kirk of Scotland, haldin at Glasgow the tuentie-ane of November, 1638 yeiris, and his procedor therin. The rector, assessouris, principall, maisteris, and memberis forsaidis, demanded first the saidis Mr. James Sandilandis canonist, Mr. William Gordoune mediciner, and Mr. Gilbert Ross cantor, if they did put their hand, or give any commissione or power of agentrie to the said Mr. Johne Lundie; quha ansuerit they nather heard nor put their hand to any suche commissione or power; and in significatioun therof now as then, and then as now, they did disclaime all suche commissione or power. Secondlie, the said Mr. William Leslie principall, Mr. Robert Ogiluie supprincipall, Mr. Alexander Midletoune, Mr. Alexander Gardyne and Mr. Alexander Scrogie younger regentis, being likwayes demanded iff they haid giwen any such commissione or power, they ansuered they acknowledgit that they haid giwen under their hand ane commissione or power of agenting, quherof the tenor followis:-We, principall and remanent maisteris and memberis of the kingis colledge of Auld Aberdein under subscryweris, hawe nominate elected and appoynted Mr. Johne Lundie humanist and commoun procuratour of the said colledge, our werie

lawful and onlie commissioner to the generall assemblie of the kirk of Scotland, which is to be holdin and begyn at Glasgow the tuentie-ane of this instant monethe of November, giwing and granting to the said Mr. John, as our commissioner and agent, our full power to compeir befoir the said assemblie to present our humble supplicatioun, to solist and attend the ansuer therto, and generally to urge agent and prosecute the affaires and business of the said colledge withe and befoir the said assemblie, according to the tenor of our said supplicatioun, and of the instructiones giwen by ws to him in wreitt. By whilke commissione, they declared in his presence that they gawe him no warrand nather to sitt voyce nor treate of affaires in assemblie, neither beares their warrand any suche power, but onlie ane bear power of agenting as said is. Thirdlie, the saide Mr. Johne Lundie being demanded of his procedour, and why he haid sitten voyced and treated of affaires in assemblie, by and beyond the limittis and power giwen to him, ansuered and confessit that the giweris of the said commissione or power at the granting theroff declarit that they did not send him, nor gaue him warrand, to sitt voice or treate in assemblie, and that he satt and voyced in assemblie becaus that the assemblie allowed his commissioun. Being forder demanded upon what reasoun he satt and stayed in assemblie, efter his majesties commissioner in assemblie and his majesties proclamatioun at the croce of Glasgow hade discharged the said assemblie and all the procedour therof, ansuered he stayed efter the proclamatioun for thrie reasones; first, becaus he knew nothing of the said proclamatioun as he alledgit; Secondlie, becaus he sawe mony of noblemen counselleris come in to the assemblie man be man; thirdlie, becaus he came for doing of particular affaires of the colledge quhilk he haid not endit. The rector assessouris maisteris and memberis forsaidis, efter remowing of the said Mr. Johne Lundie, haweing tane the premisses to thair consideratioun, deiplie pondering and weying the sequellis thairof, and recalling the said Mr. Johne; and he compeirand personallie, they all in one voyce findes declaires and decernes that the said Mr. Johne Lundie hes transgrest the poyntis of the said commissione and power of agentrie, and therfor they all in one voyce disclaimit and disallowed the said Mr. Johne Lundie his sitting voycing stayinge or treating of materis in the said assemblie, as not warrandit be the commissione or power forsaid; and in speciall, all that he did efter the dischairge of the said assemblie and his majesties proclamatioun, withe all

that hes followit or may followe therwpone; and solemlie protestit in the meane tyme, that in caice any danger suld incurre therthrow, that the colledge and memberis therof suld be frie of the same, and of the kingis majesties wraithe theranent. Wpon the whilkis haill premisses the rector forsaid tuike instrument.

The memberis, of ane consent, ar content to hald their meittingis in the rectoris hous during the tyme of his infirmitie.

The censure towardes the giweris of the commissione and Mr. Johne Lundie referrit to the nixt meitting. The canonist and medicineris protestatione referrit to the next meitting.

At a meeting in the Newtoune of Aberdeine, the auchteint of October, M vie threttie-nyne yeiris, in the rectoris hous, wher war present the rector, Mr. Dauid Lyndsay minister at Balheluies, directed from the committie, doctor Gordoun physician, Mr. James Sandilandis canonist, Mr. Johne Lundie grammarian, Mr. Robert Ogilvie supprincipall, Mr. Alexander Gardyne, and Mr. Alexander Midletoune regentes.

The said day, in regaird of the vacancie of the place of regencie, of the third classe, by the deprivatioun of Mr. Alexander Scrogie by the committie from the generall assemblie; till the said place suld be provydit by a regent to the said classe, it was thought guid that Mr. Alexander Gardyne sould teache the said thrid classe, and attend theron, as he did on his owen proper classe, till the committie sitt, appoynted be the generall assemblie at Edinburgh to be holden at Aberdeine for visiting the said universitie; whiche paines the said Mr. Alexander, for the gude of the said universitie, promised to wndergoe and performe faithfullie.

The said day, in respect it was considdered how miserablie ruinous the three transes of the colledge wer, it was also condissended by all that, deallis being a selling, half a hundrethe sould be bought presentlie, and the saids transes, with all dilligence, sould be repaired.

In like maner, in respect of the darkness of the commoun school, for making the samen more lightsome, pleasant, and commodious, it was condiscendit that a third window sould be maid out in the wast syd thairof, (as

the rector dewysed), and the southe window in the gawell to be made fairer by lawing the sol therof, and so making it larger in light.

Moreouer, it was ordanit by commoun consent, in like manner, that the librarie suld be visited by three of the number whom the rector did appoynt; as also the commoun procuratouris comptis, the writtis of the universitie likwise by D. Gordoun, mediciner, procuratour, the canonist, and supprincipall, and a faithfull report of all these to be made to the rector.

At the Kingis Colledge, the first day of Appryll 1640 yeris, convenit
Mr. William Guild rector, canonest, supprincipall, grammarian, doc-
tor Patrik Dun doctor of medicine, and Mr. William Moir bailyie of
Aberdeine, tua of the assessouris, Mr. Alexander Gardyne regent.

The rector assessouris and memberis haue electit and chosin Johne Barclay procuratour for the natioune of Angus, George Baird for the natioune of Murray, George Midiltoune for the nation of Mar, and Patrik Sandilandis for the natioune of Louthian, all studentis in the colledge, to the effect eftir specifeit; quhilkis nationall procuratouris acceptit the said office in and wpone thame, and gave ther aithis de fideli administratione.

The said day, Mr. James Sandilandis canonist, personallie present, dimittit his office and chairge of the cannon law, to the effect the rector nationall procuratouris memberis and assessores being willing to change the said office of the cannon law, with the haill benefeit and profeitis theroff to the professioune of the civil law, now waccand be dimissione of Mr. Roger Mowatt advocat, last civilist, in the persone of the said Mr. James, micht proceid to ane formall electioune. (The quhilk dimissione wes maid be the said Mr. James wpone the speciall provisiones and conditiones following:To wit, that he be formallie and lawfullie presentit and admittit to the said office of civilist, and he prowydit to the haill proffeittis and emolumentis quhilk abefoir appertenit to him as canonist, and is equall with the subprincipall or grammarian ther provisione; and lykwayis wpone conditione, that iff any question truble or molestatione suld arise in his peacabel bruiking of the said office and benefeitis and emolumentis foirsaid, that he sall have full access and regres to the said office of the cannon law, and haill benefeit and emolumentis thairoff, notwithstanding of his dimissione foirsaid, quherwnto thir presentis sall nowayis be prejudiciall; quhilkes conditiounes and

prowisiones forsaid the said rector and memberis acceptit and allowit. The assessouris nationall procuratouris and memberis forsaidis electit and choosit the said Mr. James Sandilandis professor of the civil law, with the fruitis and emolumentis foirsaidis, during his lyftyme; quha acceptit the said professioune in and wpone him wpone conditioune and provisioune foirsaid, and gave his aithe de fideli administratione.

The said day, the rector assessouris and memberis foirsaidis have decernit and ordanit that the present regentis sall have ther yeirlie stipendis augmentit according to the proportioune of the subprincipallis present stipend and auld fundatioune, viz., of new augmentatioune to ilk ane of them. fourtie pundis money for clewin bollis wictuall convertit, tualff pundis silver, and tua bollis, beir ipsa corpora, by and attour four bollis bear and fourtieaucht, with thair buirdis auld stipendis, making in the haill the sowme of ane hundrethe pundis money and sex bollis beir, by ther buirdis foirsaidis; quhilk the commoun procuratour is ordanit to ansuer thame be assignatioune according to the accustumat forme, the silver at tua termes in the yeir, Mertimes and Witsonday yeirlie, be equall portiones, and the bear befoir Pashe yeirlie, begining the first yeris payment of the said stipend at Mertimes last and Witsonday nixt of the silver, and of the bear befoir Pashe nixt, and that for ther service as regentis from Michaelmes last to Michaelmes nixt.

At the Kingis Colledge of Abirdein, the tuentie-third day of Julii 1640 yeris, convenit the rector, Mr. James Sandilandis civilist, Mr. Johne Lundy grammarian, Mr. Alexander Midiltoune and Mr. Alexander Gardyne regentis.

The said day, the memberis convenit, all in ane voice, electit nominat and choosit doctor William Guild rector commissioner for the present generall inschewing assemblie, and ordaines ane commissione to be extendit heirwpone in forme as effeiris.
