fyve of the saids committie should be a quorum; which prorogatione is dated the twentie-seventh of September last bypast. By the tenor of which acts and commissiones the said committie above named, being fyve in number, found themselves impowered to proceid in the saids visitatione of the two colledges of Aberdeine, conforme to the particular instructions given to them be the saids comissioners, dated at Edinburgh the tuentie-fyft day of Julii, M vic nyntie yeiris; and for that effect did elect and choiss the said earle Marishall to be preses to the said meitting, and immediatlie theirefter caused read ane deputatione presented to them be Thomas Hay, shirref-clerk of Aberdein, direct be the commissioners appointed for exerciseing the office of clark register to the said Thomas Hay, dated the day of bypast, nominating and appointing the said Thomas Hay to be clerk-deput under them to the committie of the said commissione, appointed for visiting of the said universitie and colledges; wherupon the said committie admitted and received the said Thomas Hay to be their clark, to the effect above written, and administrat and gave to him the oath of alledgeance and assureance, and the oath de fideli administratione officii; who accepted and received the same. And sicklyke theirefter caused read ane other warrand, relative to the warrand above wreiten, for citting of the principalls, professores, regents, and others masters of the colledges of Aberdein, and als all the leidges who had any thing to object against them, to compeir this day and place, to the effect therin mentioned, dated the said tuentie-seventh of September, M. vic and nyntie yeiris, with the executiones theirof, wnder the hand of William Moir, messenger, beiring them to have been lawfullie citted to the said day and place to the effect forsaid. Be vertue wherof the saids principalls, professores, regents, and other masters of the saids two colledges being lawfullie callit; compeired, doctor George Midltone principall of the kings colledge, Mr. John Moir civilist, doctor Patrick Urquhart mediciner, Mr. George Fraser subprincipall, Mr. Patrick Gordone humanist, Mr. William Black, and Mr. Alexander Frasers, regents in the said kings colledge; and als Mr. Robert Patersone principall of the Marischall colledge, Mr. George Liddell professor of mathematicks, Mr. George Peacock subprincipall, Mr. Alexander Litster, Mr. James and Mr. Alexander Moirs regents of the said Marischall colledge. Lykas, doctor James Gairdin professor of divinitie in the kings colledge, and doctor Patrick Sibald professor of divinitie in the Marischall colledge, being called and not compeirand, were allowed be the said committie to attend to-morrow, and declaired they

would then receive them. Theirefter, doctor George Midltoune, principall of the kings colledge, haveing represented to the said committie that Mr. George Skein, on of the regents of the saids kings colledge, wes for the present at Glasgow, about his necessar affairs, and so could not attend this present meitting, but wonld be present at the generall visitation at Edinburgh, the first of November next; in respect wherof the committie forsaid excused him, he attending the said generall visitatione the tyme forsaid. And immediatlie thairefter the said committie did adjourne themselves till to-morrow, at ten a clock at the Newtoune colledge, in the principalls chalmer theirof, and ordaines the principalls, professores, regents, and other members abone wreiten, to attend the said tyme and place, and bring along with them the foundationes and other wreits relateing to the saids two colledges; and als ordaines all the leidges, haveing anything to object, to compeir the said tyme and place. Sic subscribitur, Marischall preses.

At the Marischall Colledge of Aberdein, the sexteint day of October, M. vic four score ten yeiris, at ten a clock in the forenoon. Conveined, the earle Marischall, viscount of Arbuthnot, lord Elphinstone, master of Forbes, and the laird of Brodie, visitores forsaid. The said earle Marischall preses. The said committie haveing ordered that all parteis who had any thing to object against any of the professores, principalls, masters and members of the saids. colledges might be callit publictlie at the colledge geat; wes accordinglie three severall tymes called and non compeired. But the saids lords declaired, albeit non then compeired for that effect, yett they were readie to heir them at any tyme dureing their meitting. Theirefter the haill members of both the saids colledges being called, they were all present except Mr. George Skein regent, who wes excused; and doctor George Midltoune principall of the said kings colledge being called, compeired, and at the desyre of the saids visitores produced before them ane double of the foundatione of the said colledge of ane old character, and the said committie ordained him to produce ane other double, which he acknowledged the colledge had of ane newer character, and which double the said principall sent for, and produced the same to be sein and revisited be the said committie. The lords of the committie continues the principalls, masters, and other members of the Old Towne colledge to the efternoone. The saids lords of the committie haveing called doctor Patrick Sibbald professor of divinitie in the Marischall colledge, they desyred him to produce his dictats, which he wes in use to teach the students, in the efternoon. Lykas, the forsaid com

mittie haveing proceided to the calling of the maisters and members of the said Marischall colledge, compeired Mr. Robert Pattersone principall, and gave in ane double of the foundatione of the said colledge, with the doubles of the severall mortificationes belonging to the said colledge, to be sein and considdered at lenth be the said committie. The committie forsaid adjourned the meitting to three a clock in the efternoon. Marischall preses.

Att the Marischall Colledge of Aberdein, the sexteint day of October, at three a clock in the efternoon, conveined the said earle Marischall, viscount of Arbuthnott, lord Elphinstone, master of Forbes, and the laird of Broddie, visitores forsaids; the said earle Marischall preses. The lords of the committie haveing caused read the haill instructiones given to them be the commissioners appointed be act of parliament for visiting of universities, and haveing considdered the same, it wes their judgement, as to the first article anent the professores and masters doctrine, etc., the fourth article anent their dictats, etc., and the seventh article anent the tryall of the subject taught by the professores of divinitie, that they being all laicks, and non of the ministers appointed for the committie being present to joyne with them, they were not fitt for examinatione theirof or to cognosce theirin, neither had they received any informatione from any persones against the saids masters theiranent, but were readie to receive any such informationes and to report the same. Item, haveing considdered the haill remanent articles. of the instructiones, they delaired they would take tryall and proceid accordinglie. And as to the sext article of the saids instructiones anent the foundationes, revenewes, and mortificationes of the saids colledges, and money for buying of books to the liberaries, and vaicant stipends, etc., the committie declaired they would proceid so farr theirin as the present tyme and occasion would allow. Theirefter the saids lords caused read the foundatione of the kings colledge, and fand theirby that no principall, professore, or other member in the said colledge ought to be admitted to any office theirin upon any bryb or solicitatione, but onlie upon their qualificationes; and lykwayes fand theirby that no bursars should peay any money to the masters for their leirning. Item, they haveing called for doctor Sibbald, he compeired, and conforme to the ordore of the committie in the forenoon, gave in his dictats to be considdered by all or any of them. Item, doctor James Gairden being called did compeir, and wes ordained to attend the committie to-morrow at nyne a clock; to which tyme the lords adjourned their meitting. Marischall preses.

Att the Marischall colledge of Aberdein, the seventeint day of October M vic and nyntie yeiris, at nyne a clock in the morning, conveined the saids fyue lords of the committie above named; the said earle Marischall preses. The committie haveing called for doctor James Gairdin professor of divinitie in the said kings colledge, he appeared and gave in ane paper, whereof the tenor followes:-To the right honorable the lords of the committie of visitatione for the colledges of Aberdein,-My lords, being doubtfull whether I am comprehended in the generall comissione for visitatione of schoolls and colledges, in respect that as I am not incorporated into any colledge, so I am, by vertue of my office, a member of the provinciall assemblie of Aberdein, to whom the power of nominating, electing, visiteing, and depriveing the divinitie professore in Old Aberdein, by the tenor of the foundatione of that professione and uninterrupted practise, doth belong, I humblie desyre to be excused from any farder appearance befor your lordships; and that you may be pleased to represent the caiss to the generall meitting of visitatione, who will (I presume) be tender of the concernes and priviledges both of the provinciall assemblie of Aberdein and of my successores, and in whose judgement concerning this matter I am willing to acquiesce; Ja. Gairden D. and professor of divinitie in Old Aberdein. It being lykewayes proposed to the said doctor Gairdin if he would subscrive the confessione of faith, and swear and take the oath of alledgeance to their majesties king William and queen Marie, and subscrive the certificate and assureance, and if he would declair that he did submitt to the church government as now established by law; to all which the said doctor ansuered and craved to be excused for not giveing his opinion, untill he knew the mynd of the generall meitting theiranent. The lords of the committie haveing considdered the said doctor Gairdin his representationes and ansuers to the queries abovewriten, did ordaine him to attend the generall visitatione at Edinburgh, the first of November nixt; and ordained the clark to transmitt the said principall paper given in by him to the lords and members of the generall visitatione with the extract of the report. Marischall preses. Doctor George Midltoune principall of the kings colledge compeirand; being interrogat the third article of the instructiones anent the discipline of the colledge etc., answered, that as to the discharge of the regents dutie in generall, he is perswaded that all of them are verie dilligent in attending and waiting on their respectiue duties and imployments, and remitts to the

regents themselves to answer for themselves to the particulars in the querie; and being farder interrogate upon the first article, he ansuered that hitherto he had caried himself verie peaceablie and loyallie to their majesties, and intended so to doe in tyme to come, and wes readie to give any evidence he could for that effect. And being lykewayes interrogate annent the eight article, whether or not he would subscrive the confessione of faith, and swear and take the oath of alledgeance to their majesties king Williame and queen Marie, and subscrive the certificat and assureance ordained to be taken in Julij nyntie yeiris, and if he would declair if he would submitt to the church government as now established by law; the said principall ansuered, that in regaird the instructiones provyded that first he should be tryed on his lyfe and conversatione, and his dilligence of his dutie in his functione, theirfor he humblie craved that their lordships would be pleased first to discuss that point, leist his declairing himself willing to take these ingagements should be misconstructed as a designe to save him from lybells; and their lordships declairing that they had received no informatione against him, nor knew of any thing he could be charged with theiranent, he declaired that tho [if] he were left to himself he is not desyreous to take any ingadgements of that nature, yett he, being called to it by authoritie, and free in his conscience to doe it, wes willing to take them all four. Theirefter the oath of alledgeance wes administrat to, and taken by the said doctor Midltowne; as also the confessione of faith certificate and assureance wes subscrived by him; and he declaired his willingness to submitt to the church government now established by law. Theirefter compeired the said Mr. George Fraser subprincipall, master William Black and Mr. Alexander Fraser, regents of the said kings colledge; and being interrogate anent the third article of the instructiones, gave in the following accompt of ther conveniendums to be in the morning frae seven to nyne; in the forenoon to be frae ten to tuelf; in the efternoon, if not a pleay day, from four to sex, and if ane plea day, from fyve to sex. As to the discipline, according to the statuts of the colledge, some crymes are punished corporallie, others by pecuniall mulet, and grosser crymes by extrusione. As to the examinatione of the schollars upon their notts, it is the task of the masters in all the three convieniendums to examine them upon their notts and dictats, both in phisiologie and mathematicks. As to the office of hebdomaders; it is to attend and say prayers, morning and evining, in the comone schooll, to see the cattalloge faithfullie citted, to attend and say grace at the
