GENERAL ASSEMBLY

STATE OF ARKANSAS.

Passed at the Session held at the Capitol in the City of Little Rock, Arkansas,

1887.

ACT I.

AN ACT For the Relief of the Heirs of James Barker.

PREAMBLE.

SECTION.

1. Commissioner of State Lands authorized to convey certain lands to heirs of James Barker; Act in force from passage.

WHEREAS, At a sale of Section sixteen (16) in Township twelve (12) south of Range eight (8) west, made by Jonathan Furguson as School Commissioner of Drew County, on May 30, 1857, James Barker purchased the north half of the northeast quarter, and the southwest quarter of the northeast quarter, and the northeast quarter of the northwest quarter, and the south half of the northwest quarter of said section and paid for the same.

Whereas, By mistake of the officers only the south half of the section was conveyed to him; and,

Whereas, Said James Barker has since died; now, therefore, Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the Commissioner of State Lands is hereby authorized and directed to convey the north half of the northeast quarter, and the southwest quarter of the northeast quarter, and the northeast quarter of the northwest quarter, and the south half of the northwest quarter of said Section sixteen (16) in Township twelve (12) south of Range eight (8) west, to the heirs at law of said James Barker, and that this Act take effect and be in force from and after its passage.

Approved March 8, 1887.

ACT II.

AN ACT for the Relief of Miss Annie B. Wells.

PREAMBLE.

SECTION.

1. Appropriates money for service; Act in force from passage.

WHEREAS, Miss Annie B. Wells under the employment of the Board of Trustees of the Arkansas School for the Blind will on the 31st day of March next, have fulfilled her contract, and by the terms thereof be entitled, to three hundred and thirty three and thirty-three one-hundredths dollars ($333.33-105) being for services from the first day of May, 1886, to said thirty-first day of March, 1887; therefore,

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the sum of three hundred and thirtythree dollars and thirty-three cents be, and the same is hereby

appropriated out of any moneys in the Treasury, not otherwise appropriated, to pay Miss Annie B. Wells for her services as a teacher in the Arkansas School for the Blind from the first day of May, 1886, to the first day of March, 1887, and this Act shall be in force from and after its passage.

Approved March 18, 1887.

ACT III.

AN ACT Providing for an Election in Prairie County, for the Relief or Non-relief

of the Bondsmen of H. R. Ward, Ex-Treasurer of Prairie County, Arkansas. PREAMBLE

SECTION

1. Question to be submitted to voters of School District.

2. Duty of School Directors.

3. Form of ballot.

4. Effect of vote, if either for or against relief

5. Clerk of school meetings to certify and record vote.

6. Special election to be ordered by County Judge; how notice shall be given.

7. Laws governing general elections applicable in this.

8. Clerk of County to certify election returns

WHEREAS, At the general election of 1884, H. R. Ward was elected Treasurer of Prairie County, Arkansas, and gave bond with T. T. Buck, R. B. Carl Lee, D. P. Small, Wm. North, Ida Jamison, Joe Johnson, A. S. Aydeloff, A. G. Hooper, J. S. Brown, B. H. Murphy, H. L. Stephenson, C. A. Judson, J. W. Johnson, W. M. Matthews, C. J. Flynn, A. C. Matthews, J. G. Thweat, W. S. Edmonds, J. C. Clements, Edwin Moore, J. J. Bough, D. H. Fall, J. A. Sloan, R. Dinsdale, Wm. Lee, J. B. Jamison and W. J. Tubbs as his bondsmen or sureties, said bond having been filed before the County Clerk, and approved by the County Judge of said County, on the

17th day of November, 1884. Said Ward officiated as such Treasurer thereunder up to the night of the 26th of October, A. D. 1886; and,

Whereas, On the night of the 26th of October, A. D. 1886, about 10 o'clock p.m., H. R. Ward was found about half-way between the Treasurer's office and his place of abode, bound hands and feet and gagged, and the safe of his office found opened and robbed of its contents; said Ward claiming when found, and still claims, to have been robbed; and,

Whereas, Said Ward was suspected as a party to the robbery', was arrested, arraigned before an Examining Court, and vigorously prosecuted as a particeps criminis, and after a full and exhaustive hearing of all the evidence pertaining to the case, was discharged; and,

Whereas, The shortage arising from said robbery is ten thousand and eighty dollars, and consisted wholly of County, General and District School funds, which said amount is a surplus on hand; and,

Whereas, About thirteen hundred or two-thirds of the voters and taxpayers of Prairie County have petitioned the General Assembly to exact a law relieving the said bondsmen of H. R. Ward from any liability on said bond; therefore,

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That at the next annual school meeting after the passage of this Act, in each and every School District in Prairie County, Arkansas, affected by said robbery, there shall be submitted to the qualified voters of said School District or Districts the question or proposition of relief or non-relief of the bondsmen of H. R. Ward from any and all liability on said bond to said School District or Districts, which said bond was filed in the County Clerk's office, and approved by the County Judge of Prairie County November 17, 1884.
