AN ACT to create a new sewer commission for the village of
West Troy.

BECAME a law May 9, 1894, with the approval of the Governor. Passed,
three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. On or before the first day of October in the year eighteen hundred and ninety-four, and every fifth year thereafter on or before the first day of October in such year, the president of the village of West Troy shall appoint five resident taxpayers of said village to be known as and constitute the sewer commission of the village of West Troy. Such appointment shall be made by the president aforesaid filing a certificate thereof with the clerk of said village, and reporting such appointment to the board of trustees at a regular or special meeting thereof held at any time prior to the fifteenth day of October in said year, and said board of trustees shall cause the fact of such appointment by the president to be recorded in the minutes Term of of said meeting of said board. Said appointment shall be for the term of five years, to commence on the first day of NovemOath of ber following such appointment. Each member of said sewer commission so appointed shall, at least five days prior to such first day of November, take and subscribe the oath of office prescribed by section one of article twelve of the constitution, Report of and file the same with the clerk of the village. Said clerk of the village shall report such action to the board of trustees of the village of West Troy, at its first meeting held thereafter, and said board of trustees shall cause the fact of such action to be recorded in the minutes of said meeting of said board. § 2. All services performed by said, sewer commission, or the Compensa various members thereof, shall be rendered without compensation. Said superintendent shall receive a salary of fifty dollars per month. § 3. In case any member of said sewer commission shall decline Vacancies to act, or a vacancy shall occur in said commission by reason of the slon. death, removal from the village, or inability to act of any of said commission, then and in such case the members of the commission acting are hereby authorized, empowered and directed to fill such vacancy or vacancies by the appointment of such number of resi dent taxpayers of said village as shall be necessary to maintain the same number of acting commissioners as are named in section one of this act, such appointment to be made by a majority vote of the acting members of said commission, and when made a notice of such appointment shall be given to the board of trustees of said village and filed with the clerk thereof.

§ 4. § 6. AN ACT to revise the charter of the city of Elmira.

BECAME a law May 9, 1894, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

TITLE I.

Boundaries, Civil Divisions and Incorporation of the City. Section 1. All that part of the county of Chemung included within the following boundaries shall continue to be and constitute the city of Elmira: Beginning at a point in the north line of the "David Conklin farm," so called, two hundred feet westerly from the northeast corner of said farm in the center of Hoffman street; thence northerly on a line parallel with the center line of said Hoffman street, southerly from Carr's Corners, extended northerly until said line shall intersect a line drawn easterly and westerly parallel to and thirty rods southerly from the center line of McCann's boulevard; then easterly along said line, which

is parallel to and thirty rods southerly from the center line of McCann's boulevard, to the center of Grand Central avenue, leading from the city of Elmira to the village of Horseheads, and two hundred feet easterly therefrom; thence southerly, parallel to the center line of said Grand Central avenue, one thousand feet; thence easterly in a straight line to the north line of "Diven's ditch," so called, as it leaves the abandoned Chemung canal; thence easterly along the north line of said "Diven's ditch" to Newtown creek; thence southerly along said Newtown creek to the north line of the city of Elmira as it existed April sixteenth, eighteen hundred and ninety; thence easterly along said north boundary to the northeast corner of the said city as it existed April sixteenth, eighteen hundred and ninety; thence southerly along the east line of the city of Elmira as it existed April sixteenth, eighteen hundred and ninety, to the southeast corner of the city of Elmira as it existed April sixteenth, eighteen hundred and ninety, near what is known as Arnot's mill; thence southeasterly in a straight line to the point of intersection of the south line of Water street with the westerly line of the highway known as the Baden-Baden road; thence along the said westerly line of the Baden-Baden road until said westerly line intersects the south line of Miller street extended easterly; thence westerly on said south line of Miller street extended easterly to a point two hundred feet east of the easterly line of Maple avenue; thence southerly on a line parallel with said easterly line of Maple avenue and two hundred feet easterly therefrom until the same intersects with a line running easterly and westerly and parallel with the south line of said Miller street, and distant therefrom southerly two thousand feet; thence westerly along said line parallel with the south line of said Miller street and southerly therefrom two thousand feet until the same intersects with the west line of the fifth ward of the city of Elmira as it existed April sixteenth, eighteen hundred and ninety, extended southerly; thence northerly on said extended west line of the said fifth ward and along said west line to the south bank of the Chemung river; thence westerly along the bank of the said river until the same intersects the west line of the city of Elmira as it existed April sixteenth, eighteen hundred and ninety; thence westerly on the west line of said city of Elmira as heretofore established to the northwest corner of said city as it existed April sixteenth,

line of said city as heretofore established to the place of beginning,
said boundaries being identical with those designated by chapter
one hundred and thirty-one of the laws of eighteen hundred and
ninety.

$ 2. The said city shall be divided into nine wards, respectively
as follows:

First ward. All that part of said city lying north of the center of the Chemung river, west of the center of State street and the center line of State street extended to the Chemung river, and south of the center of Church street, shall be the first ward.

Second ward. All that part of said city lying north of the center of Church street, and west of the center of State street, and of the center of the abandoned Chemung canal, and east of the center line of College avenue, shall be the second ward.

Third ward. All that part of said city lying east of the center line of State street, and north of the center of Church street, and south of the center of Fifth street, and the line thereof continued, shall be the third ward.

Fourth ward. All that part of said city lying south of the center of Church street, east of the center of State street, and the center line thereof continued southerly to the Chemung river, and north of the center of the Chemung river, shall be the fourth ward.

Fifth ward. All that part of said city lying south of the Chemung river and north and west of the following designated lines, to wit: The center line of Mount Zoar street from the westerly boundary line of said city to the center of South Main street; the center line of South Main street from its intersection with the center line of Mount Zoar street to the center line of Pennsylvania avenue; the center line of Pennsylvania avenue from its intersection with the center line of South Main street to its intersection with the center line of South Second street; the center line of South Second street from its intersection with the center line of Pennsylvania avenue to its intersection with the center line of the railroad of the New York, Lake Erie and Western railroad company; the center line of the railroad of the New York, Lake Erie and Western railroad company from its intersection with the center line of South Second street to its intersection with the center line of Pennsylvania avenue; the center line of Pennsylvania avenue from its intersection with the center line of
