of the said town, and in the execution of the duties of his office shall have all and the same powers as constables in criminal cases; the said bailiff, before entering upon the duties of his office, shall make oath before one of the said commissioners that he will faithfully and impartially execute the duties of his office, according to the best of his skill and judgment, without favor or prejudice, and shall also give bond to the state of Maryland in such penalty as the said commissioners may direct, and with sureties to be by them approved, for the faithful performance of his duties as bailiff, and for the payment to the said commissioners or their agent, of all fines and other moneys received or collected by him in said capacity, and the said bond shall be recorded in the office of the clerk of the circuit court for Worcester county.

147. The said commissioners shall erect lamps and public lamps. lamp-posts at such places in said town as they may think proper, and shall provide for lighting said lamps, as well as those already erected.

Ordinances to be published.

Sub-Sec. 1. The said commissioners may purchase a fire engine for the use of said town, by and with the consent of a majority of the legal voters of said town, to be ascertained by an election to be called by the said commissioners for that special purpose, of which notice shall be given by public notices and by insertion for at least two weeks before said election in a newspaper printed in said town.

Sub-Sec. 2. The said commissioners shall have power to extend or otherwise change the limits of said town whenever they shall deem it expedient.

Sub-Sec. 3. The said commissioners may pass all ordinances necessary to give effect and operation to the powers vested in them.

Sub-Sec. 4. All ordinances enacted by the said commissioners shall be immediately made public, either through some newspaper printed in Snow Hill or by printed handbills posted in not less than five conspicuous places in said town.

It is further enacted that the seven commissioners now in office shall remain and continue to be commissioners of Snow Hill until the first election under this act, and until their successors are elected and qualified.

STATE'S ATTORNEY.

1870, c. 350 repeals and re-enacts 1864, c. 94 [Sup. 1861-7, p. 651] as follows:

Allowance in

166. The county commissioners of Worcester county 1870, c. 350. are required to allow to, and levy for the use of the trial cases. state's attorney for Worcester county, in all cases which may be hereafter tried by him in said county, the fees following, to wit: In every case of murder, arson or rape, twenty dollars; in every case of felony, other than murder, arson or rape, ten dollars; in every case of misdemeanor, punishable by confinement in the penitentiary, five dollars; and in all other misdemeanors, three dollars and thirty-three and one-third of a cent; provided, that this act shall not take effect until Proviso. the expiration of the term of the present state's attorney for Worcester county, said fees to be in addition to the regular appearance fees now allowed by law.

1870, c. 190 repeals section 1 of 1868, c. 442, and re-enacts the same to read as follows:

167. If any person or persons shall haul or fish with any seine or seines over one hundred fathoms in length in Synapuxent bay or its tributaries, or in any of the bays or their tributaries, on the eastern side of Worcester county above the line of Virginia, he or they shall be fined in a sum not exceeding one hundred dollars, for the first offence, and two hundred dollars for hauling larger every subsequent offence, with all costs accruing in the prosecution of such offender or offenders.

REGISTER OF WILLS.

1870, c. 152 adds the following:

168. The register of wills of Worcester county, in register during the recess of the orphans' court of said county, may pass any account or claim against the estate of a deceased person for any amount not exceeding one hundred dollars, and on the return of any inventory of the personal estate of a deccased person, may pass an order for a public sale of the property contained therein, in a case where, by law, said court could have passed such order.

1870, c. 373, s. 1. Prairie chick

WILD FOWL.

1870, c. 373 adds the following:

169. It shall not be lawful for any person to shoot ens protected. at, trap, catch, or in any manner take or kill any prairie chicken in Worcester county within four years from the date of the passage of this act.

170. If any person shall violate any of the provisions of this act, he shall forfeit the gun or other instrument used in said taking or killing, and shall be deemed guilty of a misdemeanor, and shall pay a fine of not less than ten nor more than twenty dollars, to be recovered by action of debt in the name of the state, before a justice of the peace for Worcester county aforesaid, or by indictment in the circuit court of said county, said fine to be paid the one-half to the informer and the other half to the board of county school commissioners for said county.
