Road repair tax.

nineteen hundred fifteen, is hereby amended to read as fol-
lows:

SEC. 1. The highways in every organized township in this State shall be laid out, improved and maintained by two money taxes; one tax shall be known as the road repair tax, and shall be assessed on all property in the township outside of the limits of incorporated villages, which tax shall not exceed fifty cents on each one hundred dollars valuation according to the assessment roll of the last preceding year, except in townships with an assessed valuation of less than five hundred thousand dollars where the tax One per cent. shall not exceed one dollar on each one hundred dollars valuation, according to the assessment roll of the last preHighway im- ceding year; and the other tax shall be known as the highway improvement tax and shall be assessed on all taxable property in the township, including that within the limits of incorporated villages, which tax shall not exceed fifty cents on each one hundred dollars valuation, according to the assessment roll for the last preceding year, except in townships with an assessed valuation of less than five hundred One per cent. thousand dollars where the tax shall not exceed one dollar on each one hundred dollars valuation, according to the assessment roll of the last preceding year.

AN ACT to amend section seven of chapter five of act num-
ber two hundred eighty-three of the Public Acts of nine-
teen hundred nine, approved June two, nineteen hundred
nine, as amended, entitled "An act to revise, consolidate
and add to the laws relating to the establishment, opening,
improvement, maintenance and use of the public highways
and private roads; the condemnation of property and gravel
therefor; the building, repairing and preservation of bridg-
es; setting and protecting shade trees, drainage, cutting
weeds and brush within this State, and providing for the
election and defining the powers, duties and compensation
of State, county, township and district highway officials."

The People of the State of Michigan enact:
SECTION 1. Section seven of chapter five of act number
two hundred eighty-three of the Public Acts of nineteen hun-
dred nine, approved June two, nineteen hundred nine, as
amended, entitled "An act to revise, consolidate and add to
the laws relating to the establishment, opening, improvement,

SEC. 7. The terms "roads" or "public roads" or "public Terms wagon roads" in this act shall, at all times, be construed to defined. mean the leading public wagon roads outside of incorporated villages and cities: Provided, That in passing through or upon Proviso. the boundary line of such incorporated villages or cities, roads which were legally laid out and established as township roads before the incorporation of such villages or cities shall be considered public wagon roads within the meaning of this act.

AN ACT to require the filing in the office of the Auditor
General of certain data and records relating to the public
streets, highways and alleys in cities and villages of this
State.

The People of the State of Michigan enact:

SECTION 1. Whenever the common council of any city or Certification village or the board of commissioners in municipalities hav required to be ing a commission form of government shall by resolution auditor or other legislative enactment open any new street, highway or alley, or vacate any street, highway or alley or any portion of the same, or extend, widen or change the name. of any existing street, highway or alley, it shall be the duty of the clerk or recorder of such city or village within thirty days after the adoption of such resolution or other legislative enactment to forward to the Auditor General a certified copy of the same together with his certificate giving the name or names of any plat, subdivision or addition affected by such resolution or legislative enactment.

AN ACT to prescribe the power of school districts, having a population of not less than fifteen thousand and not more than one hundred thousand, where taxes are based on a per capita for each child of school age, to impose and collect taxes for school purposes, and to repeal all acts or parts of acts inconsistent therewith.

The People of the State of Michigan enact:

SECTION 1. The district board or board of education of any school district in the State of Michigan, whose population shall not be less than fifteen thousand and not more than one hundred thousand, wherein taxes authorized to be raised for school purposes are based upon a rate per capita for each child of school age as shown by the last preceding school census of the district, is hereby authorized to impose a tax on the taxable property of the district for the purpose of paying the ordinary expenses of conducting its schools and of paying all or any part of the principal and the interest on the bonded indebtedness of the district, to be levied and collected in the same manner as provided by law for school district taxes, in an amount not exceeding the rate per capita for each child of school age as shown by the last preceding school census of the district, as fixed by the taxable inhabitants of such school district at any regular or special meeting of such district. The fixed rate per capita shall continue until changed and a new rate fixed at a regular meeting of the district by an affirmative vote of a majority of the taxable inhabitants of the district voting thereon.

SEC. 2. All acts or parts of acts, whether local or general, in anywise conflicting with the provisions of this act are hereby repealed.

AN ACT making appropriations for the Ionia State Hospital, for general repairs and special purposes for the fiscal year ending June thirty, nineteen hundred eighteen, and to provide a tax to meet the same.

The People of the State of Michigan enact:

SECTION 1. There is hereby appropriated out of any moneys in the State treasury, not otherwise appropriated, the

sum of nineteen thousand seven hundred twenty-five dollars and seventy-three cents, for the use of the Ionia State Hospital for the fiscal year ending June thirty, nineteen hundred eighteen, for purposes and in amounts as follows: For the purchase of additional acreage of land adjoining the hospital property, two thousand seven hundred twenty-five dollars and seventy-three cents; for erecting and equipping an electrical generating plant, eight thousand dollars; for the construction of airing porches on the patients' buildings, nine thousand dollars: Provided, That if the amount desig- Proviso, nated in this section for any one of the purposes stated be transfer of insufficient to complete the work or purchase the equipment stated, any surplus remaining after the completion of the work or purchases specified in this section may, by obtaining consent of the State Board of Corrections and Charities, and the Auditor General in writing, for any expense in excess of the special appropriation as incurred, be used in the account or accounts where such deficiency seems unavoidable, the intent of this proviso being to make the entire nineteen thousand seven hundred twenty-five dollars and seventy-three cents available for the purposes stated herein: Provided, That Proviso. in the judgment of the State Board of Corrections and Charities and the Auditor General, it is deemed advisable to make the transfer for which provision is hereby made: And provided further, That the board of trustees of the Ionia State Hospital may obtain money under this section before July first, nineteen hundred seventeen, in such amounts as they may, by requisition, certify to the Auditor General are necessary for immediate use, which amounts, thus advanced, shall be deducted from the total amount when the appropriation becomes available.

SEC. 2. SEC. 3. The Auditor General shall incorporate in the State Tax clause. tax for the year nineteen hundred seventeen the sum of nineteen thousand seven hundred twenty-five dollars and seventythree cents which, when collected, shall be credited to the general fund to reimburse the same for the money hereby appropriated.

AN ACT to make an appropriation for the erection of a coal house at the Michigan Soldiers' Home, and to provide a tax to meet the same.

The People of the State of Michigan enact:

SECTION 1. There is hereby appropriated for the Michigan Soldiers' Home, the sum of two thousand five hundred dollars to be expended for the construction of a coal house.

SEC. 2. The sum appropriated by the provisions of this act shall be paid out of the State treasury to the treasurer of the Michigan Soldiers' Home at such time and in such amounts as the general accounting laws of the State prescribe, and the disbursing officer shall render his accounts to the Auditor General thereunder.

SEC. 3. The Auditor General shall incorporate in the State tax for the year nineteen hundred seventeen, the sum of two thousand five hundred dollars, which when collected, shall be credited to the general fund to reimburse the same for the money hereby appropriated.

This act is ordered to take immediate effect.

AN ACT to amend section twenty-one of chapter four of act number three of the Public Acts of eighteen hundred ninetyfive, entitled "An act to provide for the incorporation of villages within the State of Michigan and defining their powers and duties," the same being section two thousand six hundred eighteen of the Compiled Laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. Section twenty-one of chapter four of act number three of the Public Acts of eighteen hundred ninety-five, entitled "An act to provide for the incorporation of villages within the State of Michigan and defining their powers and duties," the same being section two thousand six hundred eighteen of the Compiled Laws of nineteen hundred fifteen, is hereby amended to read as follows:

SEC. 21. The president and trustees shall each receive such sum as shall be fixed by ordinance, a sum of not less than one dollar for each meeting and not to exceed twenty-five dollars
