Whenever one-third of the voters of any incorporated town, so far as the number can be estimated, shall petition the board of trustees thereof to be incorporated as a city under this act, such board of trustees, by an order or resolution to that effect entered on its record, shall furnish the marshal or other proper officer with the necessary forms for taking, and direct him to take, a census of all persons who are residents within the corporate limits of such town at least forty days previous to the date of such order or resolution: Provided, however, That if it shall appear to such board of trustees by the last census of this state or of the United States, or by any enumeration made by the order of such board of trustees, within two years after the filing of such petition, that such town then has two thousand five hundred inhabitants, such board of trustees shall be at liberty to proceed in all respects as if such census had been taken in the manner provided by this act. Such marshal or other officer, with the concurrence of such board may appoint assistants, and shall, within thirty days from the time of receiving such order, make full return, under oath, to such board of the resident population of such town.
