H. B. No. 223-Mr. Bense. To provide for draining and reclaiming of marsh land, low land, and land covered with water, for agricultural purposes.

H. B. No. 224-Mr. Bense. Making appropriation for the relief of William H. Wright for value of land conveyed to the state of Ohio in consideration of locating and maintaining a fish hatchery thereon and making other improvements which the state failed to keep.

H. B. No. 225 Mr. Dever. To repeal an act entitled, "An act to provide for the revision and consolidation of the statute laws of Ohio", passed April 2, 1906.

H. B. No. 226-Mr. Ash. To provide by the use of automatic signals, visible or audible or both, and such as may receive the approval of the Ohio Railroad Commission for the purpose, for the safety of persons, passing or crossing at grade on streets or highways, over railroads, steam or electric, where not guarded by gates or flagmen, and providing penalties for its violation.

H. B. No. 227 - Mr. Wyman. To appropriate twenty-five thousand dollars for deepening, widening and straightening Loramie Creek, located in Shelby County, Ohio, to provide a sufficient outlet for the waste water of the Loramie Reservoir and the Miami and Erie Canal. H. B. No. 228-Mr. Wyman. To provide for the appointment of a State Board of Library Examiners and the examination of librarians and library employes.

H. B. No. 233- Mr. Russell. To amend Section 12912

relating to municipal and township officials being interested

in corporation contracts.

H. B. No. 237 — Mr. Reed. To amend Sections 12694 and 12696 .., relating to the practice of medicine and surgery.

Mr. Winters offered the following resolution:

H. J. R. No. 9- Mr. Winters.

Be it Resolved by the General Assembly of the State of Ohio: That the joint committee on consolidated laws is hereby authorized and empowered to employ not more than three competent persons to prepare a complete historical annotations and an index to "The General Code", and such persons so employed shall have such a number of clerks, assistants and stenographers as the joint committee shall deem necessary for the work.

The persons so employed shall first prepare a complete index and then the annotations if in the opinion of the committee they have sufficient time to complete the same.

The persons so employed shall complete their work on or before the first day of April, 1910.

The joint committee shall have the power to discharge any one so employed for incompetency or neglect of duty.

The joint committee is further authorized to receive and accept bids on any index now prepared, and if in its opinion the same is complete, correct and adequate may purchase the same.

The joint committee on consolidated laws shall fix the compensation of all employes, and the compensation shall be paid out of the contingent fund of the House and Senate upon vouchers signed by the chairman and secretary of the joint committee on consolidated laws. The resolution was laid over under the rule.

The Senate has adopted the following Joint Resolution, in which the concurrence of the House of Representatives is requested:

S. J. R. No. II—Mr. Phare. Authorizing the appointment of a joint committee to investigate alleged abuses of the canal properties of the State.

The Senate has refused to concur in the adoption of the following Joint Resolution:

The Senate has concurred in the passage of the following joint resolution:

H. J. R. No. 8-Mr. Gusweiler. Relative to the printing of additional copies of H. B. No. 54 and H. B. No. 68.

With the following amendments, in which the concurrence of the House of Representatives is requested.

Add at the end of the resolution the following: Also twenty-five hundred copies each of the following bills:

S. B. No. 3- Mr. Alsdorf.
Mr. Alsdorf.

To create the Ohio State Tax Commission, define its powers and duties, and repeal certain sections herein named.

S. B. No. 4- Mr. Alsdorf. To secure an equitable valuation of property for taxation by limiting the tax rate, limiting the power to issue bonds, removing certain penalties for improper valuation and amending certain sections of the General Code.

S. B. No. 5, Mr. Alsdorf. To create a board of administration for the institutions of the state named herein, and to repeal certain sections of the General Code.

Amend the title by adding at the end thereof, also S. B.'s Nos. 3, 4 and 5.

The Senate has concurred in the passage of the following bill: Am. H. B. No. 2 Mr. Ritter. To make appropriations to pay deficiencies authorized by the emergency board.

With the following amendments in which the concurrence of the House of Representatives is requested:

In line 22 strike out "including porters".

In line 51 strike out $445.65 and insert $439.85.

Mr. Riddle moved that the vote by which H. B. No. 9— Mr. Edwards, was lost, be now reconsidered.

Mr. Phillips moved to refer the bill to a Select Committee of One, with instructions to amend as follows:

In line four strike out the words "five thousand dollars" and substitute the words "twenty-five hundred dollars”.

Mr. Dever demanded the previous question, which was duly seconded. The question being "Shall the debate now close", which was agreed to.

Mr. Anderson demanded a call of the House, which was duly seconded, taken and 105 members answered to their names.

Those absent were: Messrs. Crawford, of Huron, Crist, Davidson, Elson, Gebhart, Gusweiler, Howard, LeBlond, Schlemmer.

The Sergeant-at-Arms was ordered to dispatch his messengers for absentees.

On motion of Mr. Bowers further proceedings under the call were dispensed with.

The question being shall the amendment be agreed to.

Which was agreed to, and Mr Phillips was appointed such committee, and reported the bill amended as instructed.
